- Draft Purchase Description This Presolicitation Notice is being posted in advance of Solicitation No. M67854-13-R-1016 for the Enhanced Flame Resistant Combat Ensemble. The forthcoming solicitation will be issued as a 100% Small Business Set-aside for Historically Underutilized Business Zone (HUBZone) Certified Businesses. Information contained in this notice is subject to change. No proposals are being requested at this time. The Marine Corps System Command (MARCORSYSCOM), Product Manager for Infantry Combat Equipment (PdM ICE), has a requirement for government-designed, Berry Amendment compliant, Enhanced Flame Resistant Combat Ensemble (EFRCE). Although the EFRCE is similar to the current Flame Resistant Combat Ensemble, the design and fabrics used to construct the ensemble have been modified to increase durability. The shirt is constructed with a FR knit fabric in the torso area and the shirt sleeves and trousers are made with a FR woven fabric printed in either Desert or Woodland MARPAT TM. Each shirt and trouser of the EFRCE must be factory permethrin treated and must conform to the permethrin concentration levels and percent bite protection requirements, as established by the Marine Corps. Permethrin treatment process and garment treatment shall comply with Environmental Protection Agency (EPA) Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) and EPA Product Performance Test Guidelines. The permethrin treatment shall not degrade any performance characteristic of the garments or present any latent defects to the cloth or garment. The estimated maximum quantity is 76K EFRCE sets annually, in which a set contains (1) pair of trousers and (1) combat shirt. The NAICS code is 315280, All Other Cut and Sew Apparel Manufacturing, with a size standard of 500 employees. The Government anticipates awarding a Firm Fixed Price, Indefinite Delivery/Indefinite Quantity (ID/IQ) contract to no more than one (1) offeror that is capable of producing at least 76K EFRCE sets within twelve (12) months from the 1st shipment of contract award. The ID/IQ contract will cover a four (4) year period of performance consisting of (4) one-year ordering periods. Evaluation factors will be set forth in the forthcoming solicitation. Potential offerors are advised that Evaluation will require offerors to submit a minimum of (2) product demonstration models for compliance to an EFRCE technical data package. A draft version of the EFRCE specification, MIL-PRF-EFRCE (Dec 2012), is included as Attachment A to this presolicitation notice. The final version of the specification, as well as EFRCE patterns, will be released with the solicitation. Solicitation Number M67854-13-R-1016 is anticipated to be issued within the next thirty (30) days and will be posted on the internet at the Federal Business Opportunities website located at the following address: https://www.fbo.gov. The online version of the solicitation will include all documents of the solicitation package. No hard copies of this solicitation will be issued. Amendments, if any, will be posted at the same location as the original solicitation. The complete solicitation package, including amendments, should be received and reviewed prior to submitting a proposal. Proposals will be due no later than thirty (30) days after solicitation issuance and shall be submitted in hard copy form only. No electronic submission of proposals will be accepted. Those responding to the solicitation have the responsibility to obtain all amendments and/or other applicable documents. Offerors are instructed to hold all questions until the solicitation has been issued. Offerors shall submit ALL questions in writing to Peggy.L.Smith1@usmc.mil. No phone calls will be accepted. All items, materials, and components thereof submitted shall be in full compliance with the Berry Amendment (10 U.S.C. 2533a). Offerors may be required to provide detailed information certifying compliance. PLEASE NOTE: As part of the GFI- Specification and/or Patterns distribution process, an offeror's accessing of any of the GFI-Specification and/or Patterns is a confirmation of the offeror's agreement to the following: The offeror agrees that it shall not, without the express written permission of the Government, use, modify, reproduce, release, perform, or display any of the GFI-Specification and/or Patterns for any commercial purpose or disclose any of the GFI-Specification and/or Patterns to a person other than its subcontractors, suppliers, or prospective subcontractors or suppliers, who require any of the GFI- Specification and/or Patterns to submit offers for, or perform, contracts under this effort. Prior to disclosing any of the GFI- Specification and/or Patterns, the offeror shall require the persons to whom disclosure will be made to provide the Government with its agreement to the terms of this paragraph. INTELLECTUAL PROPERTY: The United States Marine Corps owns the patent rights in and to the design (ornamental) and the functional features of the MARPAT TM. Furthermore, the United States Marine Corps owns trademark rights in the MARPAT TM. Still further, the patterns including, but not limited to, the MARPAT TM, and each item including, but not limited to, the documents, materials and information, and all associated intellectual property, created, generated or produced in association with this effort are the sole property of the U.S. Government and not the contractor. Therefore, without the prior written permission of the contracting officer neither the MARPAT nor any other data, documents, materials and/or information created or provided expressly for the contract shall be used by the contractor for any purpose other than those purposes that are in support of, or for its performance under, the contract.
