- THIS IS A NOTICE OF INTENT, NOT A REQUEST FOR A PROPOSAL. A SOLICITATION DOCUMENT WILL NOT BE ISSUED AND PROPOSALS WILL NOT BE REQUESTED. The National Heart, Lung, and Blood Institute (NHLBI) Office of Acquisition (OA) on behalf of the National Human Genome Research Institute, (NHGRI), intends to negotiate and award a purchase order on a noncompetitive sole source basis to BD Biosciences, 2350 Qume Drive, San Jose, CA 95131-1807. The sole source determination is based on the fact that National Institutes of Health (NIH) is the nation's leading medical research agency and the primary Federal agency conducting and supporting medical discoveries that improve people's health and save lives. The National Human Genome Research Institute (NHGRI), Genetics and Molecular Biology Branch (GMBB), investigators in the Genetics and Molecular Biology, NHGRI Flow Cytometry Core Facility provide state of the art flow cytometry services to the NHGRI community. The work involves the analysis and isolation of cells and cell populations from a wide variety of sources. GMBB currently maintain five flow cytometers for this purpose and provide services to over 50 NHGRI investigators. The Flow Core had over 1200 visits during the FY 2012 and is available to investigators seven days/week/twenty four hours/day. BD Biosciences is the only provider that can supply instrument software revisions along with preventative maintenance inspections, technical telephone consulting and unlimited on-site service visits. No other sources is authorized to provide maintenance service to this system, must be a authorized BD Bioscience engineer or technician. This purchase order will have a base with four (4) Option year periods. Base: January 2013 - September 30, 2013 Option 1: October 1, 2013 through September 30, 2014 Option 2: October 1, 2014 through September 30, 2015 Option 3: October 1, 2015 through September 30, 2016 Option 4: October 1, 2016 through September 30, 2017 Contractor Requirements : • The Contractor service contracts shall include two preventative maintenance inspections, software revisions, unlimited service calls, unlimited phone support. Government Responsibilities : • The Government will have the responsibility of the NHGRI Flow Core to provide the Contractor access to the equipment when service is required. • The Government will provide the Contractor access in a safe and appropriate environment. Reporting Requirements : • The Contractor shall provide a summary report after repair and/or preventative maintenance to the Government. Inspection and Acceptance Requirements : • The Government accepts the job performed by the Contractor after demonstration of performance. The North American Classification System (NAICS) code applicable to this requirement is 811219 and the associated small business size standard is $19.0 Million Per Annum. The acquisition is being conducted under FAR Part 13, simplified acquisition procedures, therefore the requirements of FAR Part 6 B Competitive Requirements are not applicable (FAR Part 6.001) and the resultant purchase order will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 05-62 (December 20, 2012). This requirement is under the SAT of $150,000.00 and is conducted under the authority of 41 U.S.C. 253(c) as set forth under FAR Part 13.106-1 (b) (1), Soliciting from a single source not exceeding the simplified acquisition threshold, and is exempt from the requirements of FAR Part 6, Competition Requirements. This notice of intent is not a request for competitive proposals. Interested parties may identify their interest and capabilities in response to this synopsis, by January 10, 2013 7:30 a.m. Eastern Standard Time. The determination by the Government not to compete the proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct future competitive procurement.
