- Justification for Other than Full and Open Competition - LIFE-Moms Phoenix. The awarded contract is not fixed price because the uncertainties involved in performance of the effort do not permit costs to be estimated with sufficient accuracy to use a fixed price contract. The nature of this type of requirement includes many variables. Government surveillance during performance of the contract will provide reasonable assurance that efficient methods and effective cost control are employed. The contract is awarded on a sole source basis. This action is conducted under the authority of 41 U.S.C. 253(c)(1), as set forth in FAR 6.302-1 and HHSAR 306.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. ACKCO possesses unique experience and qualifications that are necessary for conducting these clinical trial support services in the Phoenix, Arizona area with this American Indian population. ACKCO's experience includes the successful implementation and completion of multiple studies and clinical trial protocols with this American Indian population, including the Diabetes Prevention Program (DPP/DPPOS) and the Look AHEAD (Action for Health in Diabetes) project. This acquisition requires specific and extensive experience for conducting weight-control and weight-loss studies along with strong, proven working relationships with this American Indian community. ACKCO is the only identified source that has the necessary experience and the working relationships with this American Indian community necessary for successful study completion.
