- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The liquid scintillation counter is used in a wide variety of laboratory assays where a radioactive tag is applied to a sample and later counted. This instrument wilt be used in USARIEM research protocols and be stored in the Radioimmunoassay Laboratory only. If bidding an equal, offer must provide product specifications. The provision at 52.212-2 Evaluation Commercial Items is applicable to this acquisition. 52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: This is a Lowest Price Technically Acceptable Procurement. Award shall be made to the offeror whose proposal is the Lowest Price Technically Acceptable (LPTA) offer. Technical acceptability means that the quote meets all of the stated minimum specifications. Incomplete or unreasonable offers shall be rejected and eliminated from further consideration. The Government will evaluate information based on the following evaluation criteria: (1) Technical Capability factor meeting or exceeding the requirement, (2) Price (3) Past Performance. Technical Capability: Evaluation of Technical Capability shall be based on the information provided in the quotation. Quotations shall include the make and model of the products, manufacturer sales literature or other product literature, which CLEARLY DOCUMENTS that the offered product(s) meet or exceed the specifications. Technical Ratings: Technical Acceptable/Unacceptable Ratings RatingDescription AcceptableProposal clearly meets the minimum requirements of the solicitation. UnacceptableProposal does not clearly meet the minimum requirements of the solicitation. Price: A price analysis of the offer will be used to evaluate the total price to support the selection and that the price proposed is fair and reasonable. Past Performance: Evaluation of Past Performance is assessment of the offeror's capability to provide the product(s) as specified in the solicitation. This determination is based on offeror's record of relevant and recent past performance information that pertain the product(s) outlined in the solicitation. Offeror shall provide a brief description of contract work and comparability to the proposed effort. Offerors are required to provide a reference point of contact, dollar value of contract and dates of contract performance. It is not sufficient to state that it is similar in magnitude and scope, a rationale must be provided to demonstrate that it is comparable. Projects completed or in progress described in the narrative will be evaluated for scope and degree of support to DOD, other federal agencies, or other comparable international organizations. Offerors shall describe problems encountered in the performance of similar services and describe how the problems was/were resolved. A minimum of two (2), not to exceed five (5) past performance references shall be provided. Past performance information may be obtained from any other sources available to the Government, to include, but not limited to, the Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases; interviews with Program Managers, Contracting Officers, and the Defense Contract Management Agency (DCMA). In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonable assigned, the offror may not be evaluated favorably or unfavorably on at performance. Therefore, the offeror shall be determined to have an unknown past performance. In the context of acceptability/unacceptability quote mark unknown quote mark shall be considered quote mark acceptable quote mark. Technical Acceptable/Unacceptable Ratings RatingDescription AcceptableBased on the offeror's performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror's performance record is unknown. UnacceptableBased on the offeror's performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort. Technical and past performance, when combined, are equal when compared to price. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (End of provision) Offers are to include a completed copy of the provision at 52.212-3, Offer Representations and Certifications-Commercial Items with its offer.
