NOTICE TO CONTRACTOR This is a COMBINED SOLICITATION/SYNOPSIS for commercial items prepared in accordance with the format in FAR subpart 12.6 as supplemented with additional information included in this notice. This solicitation has been prepared with the intent to negotiate a Firm Fixed Price (FFP) contract, utilizing procedures under FAR part 13, for Commercial Items for Wheelchair basketball lessons for wounded warriors located at Naval Medical Center San Diego. The requirement calls for performance to commence 01 February 2013 through 31 January 2014 with a one (1) year option period. Contractor is responsible for providing full support for all items / components of the requirement not covered in the Statement of Work. This announcement constitutes the only solicitation, quotations are being requested and a written solicitation will not be issued. PAPER COPIES OF THIS SOLICITATION WILL NOT BE AVAILABLE. The Request for Quotation (RFQ) number N00259-13-T-0124 is issued as a request for quotation (RFQ). The closing date is 28 January 2013 0600 Pacific Standard Time. This solicitation documents and incorporates provisions and clauses in effect through FAC 2005-64. It is the contractor ™s responsibility to be familiar with the applicable clauses and provisions. The mission of Naval Medical Center, San Diego (NMCSD) is to be the nation ™s premier military medical center; providing world-class care, anytime, anywhere. The mission of the Health and Wellness Department is to maximize the health of all beneficiaries through primary, secondary, and tertiary prevention programs and services. Navy Medicine Health and Wellness resources will support the health and wellness needs of active duty and their family members, reserve component members, civilian beneficiaries, and retirees. 1.1.2 The Government may evaluate the quality of both professional and administrative services for purposes of contract inspection and acceptance. The Government retains no direct control over professional judgments. The Contractor shall be solely responsible for any and all liability caused by the acts or omissions of its agents or employees. The Contractor shall not in any manner represent or infer that it is an instrumentality or agent of the United States Government. The Contractor shall recognize the Commander, Naval Medical Center San Diego maintains administrative and operational responsibility for all activities within the command and may take such actions as necessary to preserve and maintain the integrity of the command, subject to the limitations prescribed by law and U.S. Navy Regulations. 1.1.3 The Contracting Officer will designate and authorize an individual to act as Contracting Officer's Representative (COR). Any such representative appointed will be specifically designated by letter from the Contracting Officer. The COR exclusively represents the Contracting Officer in all technical phases of the work, but is not authorized to issue Change Orders, Supplemental Agreements, or direct any contract performance requiring contractual modification or adjustment. Changes in the scope of work can only be made by modification properly executed by the Contracting Officer. All observations made by persons other than the Contracting Officer or the COR are strictly advisory and shall not influence Contractor operations except for administrative requirements and responsibilities specified herein. 2.0 SCOPE 2.1 Scope of Work. The Contractor shall provide various beginner, intermediate and advanced levels of wheelchair basketball instruction to those individuals with permanent physical disabilities to include, but not limited to, multiple amputations, spinal cord injuries, orthopedic or neurological disorders for all Navy, Marine, Army operation service members in support of the Health and Wellness Department, Naval Medical Center San Diego. 2.2 Specific Duties 2.2.1 The Contractor shall provide services compatible with the MTF ™s operating capacity and equipment as determined by the Commander. The services specified in this Statement of Work shall be performed in accordance with established principles and ethics of the Certified Therapeutic Recreation Specialist and National Wheelchair Basketball Association. The quality and content of the class presentations will meet or exceed professional associations that specify standards of performance for the adapted sports profession. The qualified wheelchair basketball coach shall adhere to the bylaws, policies, and procedures of the medical staff of the MTF, the directives, instructions, and notices of the MTF and Bureau of Medicine and Surgery, and applicable laws and regulations. 2.2.2 The contractor shall provide wheelchair basketball instruction and coaching to improve fitness and wellness of the Navy, Marine, and Army Wounded Warriors in support of the Health and Wellness Department, Naval Medical Center San Diego to promote positive socialization and interaction with peers. The Contractor shall provide a special focus on adaptation to the service member ™s injuries and health changes, using basketball and social interaction as a springboard for individual socialization skill building and interpersonal dynamics. Specialized experience is a must teaching members with possible PTSD, TBIs, and amputations on how to adapt to various techniques to meet their individual needs. Instructor must also have an extensive knowledge base of various physical impairments and precautions associated with those disabilities including open wounds related to recent amputations, skin break down, prosthetic use and overall general daily functioning associated with disabilities. The Contractor shall provide services on-site at the NMCSD, MWR, Building 12, and Athletic Complex on Saturdays 0930-1230 and occasionally on Monday 1230-1530. Contractor will also provide off-site services at Hourglass Field House Gym located at 10440 Black Mountain Road San Diego, CA 92126 on Wednesdays 1730-2030 and at various tournaments TBD. Other instructional sessions and tournaments may also be conducted during FY based on program requirements and determined by the by the Health and Wellness (H & W) Certified Therapeutic Recreation Specialist. 2.2.3 The contractor will assist in putting back all equipment used during the class and proper storage of equipment used. Maintenance is not provided by the contractor outside of the hours of training courses. The contractor shall inform the Government of non-operational equipment with advisement of the required repairs. 2.2.4 The Contractor shall perform services consistent with privileges approved by the Commander. 2.2.5 Contractor employees shall hold current First Aid and CPR certifications and have them readily available for inspection. 2.2.6 Contractor employees shall have ability to communicate orally and in writing. 2.2.7 Available equipment at the gymnasium storage unit: Basketball wheelchairs Basketballs Tool kit Extra tubes and tires and other required equipment First-aid kit, etc. Water Cooler 2.2.8 The contractor will assist in putting back all equipment used during the class and proper storage of equipment used. 2.2.9 The contractor shall report any changes to the course content or schedule to the H& W Certified Therapeutic Recreation Specialist 2.2.10 Administration 2.2.11 The Contractor is responsible for adherence to all MTF administrative procedures and instructions that apply to the Health and Wellness Department. 2.2.12 All records produced in the performance of this contract and all evaluations of patients are the property of, and subject to the exclusive control of, the Government. The Contractor may retain a copy of all such records or evaluations, but may not provide further copies or disclose the information from such records or evaluations to third parties. All requests from other treatment facilities or other individuals for patient records shall handled in accordance with procedures specified by MTF instructions. 3.0 GOVERNMENT FURNISHED EQUIPMENT. 3.1 For services performed on site at the NMCSD, the government will provide, without cost to the contractor, the facility, equipment, and services listed below which the contractor shall use for the performance of this contract: 3.1.1 Facility A gymnasium at Building 12, MWR Athletic complex on Mondays 1230-1530 and Saturdays 0930-1230 and Hourglass Field House Gym located at 10440 Black Mountain Road San Diego, CA 92126 on Wednesdays 1730-2030 or otherwise specified by the Health and Wellness (H & W) Certified Therapeutic Recreation Specialist. 3.1.2 Equipment Basketball wheelchairs, basketballs, tool kit, extra tubes and tires and other required equipment, first-aid kit, etc. will be supplied by NMCSD. 3.1.3 If the contractor deems that additional Government furnished property or services are required to perform, the Government will consider requests for such additional property or services. However, approval by the Government of such requests shall be contingent on available funds, in accordance with the mission of the MTF and the approval of the Commander, NMCSD. Denials of requests/delays in acquiring any additional property or services shall not be cause for Contractor nonperformance or claims under this contract. 3.1.4 Government property and services furnished to the Contractor shall be for the sole purpose of performance of contract requirements. Property and services shall not be removed from the Government installation. 3.2 Orientation The Government will provide an eight-hour Command orientation for contract employees assigned to this contract. The orientation will take place within six months of contract award. Contract employees are required to attend this 8-hour orientation. If the successful contractor has previously attended this orientation, the requirement will be waived. 4.0 QUALITY ASSURANCE 4.1 Contractor Quality Control 4.1.1 Quality of Service The services specified in this Performance Work Statement shall be performed in accordance with established principles and ethics of the Health and Wellness Program Staff. The quality and content of the class presentations will meet or exceed the current recognized standards established by the Joint Commission on Accreditation of Healthcare Organizations (Joint Commission), the American Hospital Association (AHA) and those other professional associations that specify standards of performance for sports and rehabilitative activities. 4.2 Government Quality Assurance 4.2.1 The Government will monitor contractor performance in accordance with the objectives detailed in the following Quality Assurance Surveillance Plan (QASP). 4.2.2Quality Assurance Surveillance Plan (QASP) Performance ObjectiveStandardAcceptable Quality LevelSurveillance Method Wheelchair Basketball IAW Paragraph 2.2.2All new patients will be able to perform basic basketball skills: dribbling, passing and shooting from a wheelchair. 80% in 6 monthsObservation by the Program Manager Socialization skills IAW Paragraph 2.2.2 All new student patients will display increased confidence in socialization.70% in 6 monthsObservation by the Program Manager 5.0 OTHER PROVISIONS 5.1 Hours of operation. The Health and Wellness Department ™s operating hours are from 0600-2000, Monday, Tuesday, Wednesday and from 0600-1630 on Thursday and Friday. 5.2 Federal Holidays. Contractor services will not be required on the following federally established holidays: New Year ™s Day, Martin Luther King ™s Birthday, President ™s Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veteran ™s Day, Thanksgiving Day and Christmas Day. The government will not compensate the contractor for these periods of planned absences. 5.3 Identification Badge. The contract workers shall display an identification badge, which includes the contract worker ™s full name and professional status (furnished by the Government) on the right breast of the outer clothing. Security badges provided by the Government shall be worn when on duty. Upon termination, the contract worker will return identification badge to the COR/GPOC. 5.4 Records. The contractor is responsible for adhering the conditions contained in the clause œPRIVACY AND SECURITY OF PROTECTED HEALTH INFORMATION (AUG 2007) contained in the contract. All records produced in the performance of this contract and all evaluations of patients are the property of, and subject to the exclusive control of, the Government. The Contractor may retain a copy of all such records or evaluations, but may not provide further copies or disclose the information from such records or evaluations to third parties. All requests from other treatment facilities or other individuals for patient records shall handled in accordance with procedures specified by MTF instructions. The Government intends to award a firm, fixed price contract resulting from this combined synopsis/solicitation to the responsive and responsible offeror whose conforming response is determined to provide the best value to the Government, price and other factors considered. The following factors to be used to evaluate offers: Delivery Schedule. Defined as, lead time necessary to receive the product. Technical Capability. Defined as, an assessment of the prospective contractors key management personnel to determine if they have the basic knowledge, experience, and understanding of the requirements necessary to provide the requested items. Past Performance. Provide three (3) references, addressing that you have provided the same or similar items in the last 3 years. Price. Technical capability and past performance, when combined, are significant evaluation factors that will be used to arrive at a best value award decision. Contractors who do not meet the first 2 factors will not undergo a price evaluation. (modify according to FAR Clause 52.212-2) The Government will only consider firm fixed-price quotations.
