- (i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii) This solicitation is issued as a Request for Quotations (RFQ) under RFQ number DOL131RQ21629. (iii) This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 05-62. (iv) This solicitation is being issued as a TOTAL SMALL BUSINESS SET-ASIDE in accordance with FAR Part 19, under NAICS 541519 (SBA Size Standard: 150 employees). (v) This requirement consists of three (3) Line Items: 0001-Maintenance and support for 68 existing RAD Studio Enterprise Networked Named user software licenses-Base Period (Date of Award - December 31, 2013) (Part Number BDE000MMNNWB0-R3). Manufacturer: Embarcadero Technologies. 1001-Maintenance and support for 68 existing RAD Studio Enterprise Networked Named user software licenses-Option Year 1 (January 1, 2014 - December 31, 2014) (Part Number BDE000MMNNWB0-R3). Manufacturer: Embarcadero Technologies. 2001-Maintenance and support for 68 existing RAD Studio Enterprise Networked Named user software licenses-Option Year 2 (January 1, 2015 - December 31, 2015) (Part Number BDE000MMNNWB0-R3). Manufacturer: Embarcadero Technologies. (vi) Description of requirements for the items to be acquired: The contractor shall provide maintenance and support for sixty-eight RAD Studio software licenses currently deployed in OCIO-DITMS' network. Continuous maintenance and support of OCIO-DITMS' deployed RAD Studio software licenses are required in support of OCIO/DITMS' business needs. Upon purchase order award, the contractor shall provide DOL with all up-to-date updates/upgrades/patches for calendar year 2013 and for the remaining period of performance shall provide, as outlined as follows, the Commercial terms and conditions of support as prescribed by the manufacturer, Embarcadero/CodeGear: Unlimited incidents for the covered Embarcadero Product(s); Access to support for up to five Authorized Contacts; Access to all product updates and upgrades released during the term of the agreement; Product updates and upgrades delivered by electronic transfer or on CD-ROM; Phone access to the Embarcadero Support Center during regional business hours; Access to the Embarcadero online knowledgebase; Online support incident submittal and tracking; full access to Embarcadero Support Online; Highest priority for submitted support incidents; Critical failure support, whereby a patch may be provided to the customer for critical situations where a deployed system is inoperable; Defined response time goals, linked to the support incident severity. (vii) The period of performance shall consist of a base period and two (2) option years as follows: Base Period: Date of Award - December 31, 2013 Option Year 1: January 1, 2014 - December 31, 2014 Option Year 2: January 1, 2015, December 31, 2015 The base period shall begin from Date of Award through 31 December 2012. Upon purchase order award, the contractor shall provide DOL with all up-to-date updates/upgrades/patches for calendar year 2013 (From January 1, 2013). The place of performance is: US Department of Labor Office of the Chief Information Officer 200 Constitution Ave, NW Room N-4409 Washington, DC 20210 (viii) The provision at 52.212-1, Instructions to Offerors-Commercial Items, applies to this acquisition. Addendum to 52.212-1(c) - Period for acceptance of offers: The vendor agrees to hold the prices in its quotation firm for 60 calendar days. (ix) The clause at 52.212-2, Evaluation-Commercial Items, applies to this acquisition. Award will be offered on the basis of Lowest Price Technical Acceptable (LPTA). Award will be based on price alone to the vendor who meets the requirements of this solicitation. (x) Vendors are required to include with its quotation, a completed copy of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items. (xi) The clause at 52.212-4, Contract Terms and Conditions-Commercial Items, applies to this acquisition. (xii) The clause at 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial items applies to this acquisition. The following FAR clauses cited in the clauses under section (b) of this provision are applicable to this acquisition: (1) with its alternate, (7), (12) with its alternate I, (14), (18), (23), (26), (27), (28). (29), (30), (31), (32), (33), (34), (38), (42), (47) (xiii) The clause at 52.217-9, Option to Extend the Term of the Contract, applies to this acquisition. Insert "one (1)" for the number of days the Government has to exercise the option prior to the expiration of the purchase order. Insert "seven (7)" for the number of days the Government has to provide its notice of intent to exercise an option. The clause at 52.232-18, Availability of Funds for the Next Fiscal Year, applies to this acquisition. (xiii) Quotations must be submitted via email no later than 1:00pm, EST, 02 January 2013.
