- The purpose of this announcement is to publicize the intent of the Federal Aviation Administration (FAA) to extend the current Advanced Technologies and Oceanic Procedures (ATOP) contract (ATOP Contract) with Lockheed Martin in accordance with Acquisition Management System 3.2.2.4 for 8 years (two year base year and six 1-year option periods) to continue the development and lifecycle support service for ATOP program s Ocean21 Air Traffic Control (ATC) system. The cost of the contract extension is estimated to be more than $400,000,000.00 assuming all options are exercised. The current contract with Lockheed Martin is set to expire July 31, 2013. Ocean21 provides automation capabilities that support oceanic procedural and radar airspace. The Ocean21 system integrates a wide range of surveillance data types (primary and secondary radar, Automatic Dependent Surveillance -Contract (ADS-C), High Frequency (HF) and Controller-Pilot Data Link Communications (CPDLC) position reports), system-maintained electronic flight data, CPDLC and Air Traffic Services (ATS) Interfacility Data Communications (AIDC) support, and automated conflict detection for a seamless ATC environment for the controller. The design provides functionality to reduce controller workload and separation minima, thereby increasing airspace capacity. This procurement also provides services to include software maintenance, software enhancements, field maintenance, depot support, system engineering, training and technical support, and provides options for new Ocean21 sites, NextGen oceanic related software, and technical refresh. The FAA has been engaged in a contract dispute with Lockheed Martin related to the extent of the Agency s data rights in restricted rights software elements within the Ocean21 system. In consideration of all of the issues, the FAA has determined that it is in its best interests to enter into an agreement with Lockheed Martin to resolve the dispute and address the FAA s rights to certain restricted rights computer software that form core components of the Ocean21 system (ATOP Settlement Agreement). Based upon the ATOP Settlement Agreement, the FAA will enter into an 8-year single source extension or follow-on of the ATOP Contract with Lockheed Martin. A summary of certain terms of the ATOP Settlement Agreement is also provided as an attachment to this Announcement. For any entities who would be interested in supporting the prime contractor Lockheed Martin with this requirement, please submit the attached Business Declaration form and the attached interested parties information sheet, and provide a copy of your SBA 8(a) certification letter if applicable. For small businesses this effort would be under the principal North American Industry Classification System (NAICS) code 541512, Computer Systems Design Services, with a size standard of $25 M. The FAA, based on feedback from industry, will create a list of interested parties, and provide the list to the prime contractor for its consideration. All interested parties will be included on the list for the purpose of promoting subcontracting/teaming.
