Sources Sought Notice DOC52PAPT1300013 - Statement of Work Synopsis: THIS IS A REQUEST FOR INFORMATION (RFI) BEING RELEASED PURSUANT TO FEDERAL ACQUISITION REGULATION (FAR) PART 10: MARKET RESEARCH. This RFI is issued solely for informational, market research, and planning purposes only. It does not constitute a Request for Proposal (RFQ) or a promise to issue an RFQ in the future. This RFI does not commit the Government to contract for any supply or service whatsoever. Furthermore, the USPTO is not at this time seeking proposals, and will not accept unsolicited proposals. Respondents are advised that the United States (U.S.) Government will not pay for any information or administrative cost incurred in response to this RFI. All costs associated with responding to this RFI will be solely at the responding party's expense. Responses and submissions will become Government property and will not be returned. Not responding to this RFI does not preclude participation in any Request for Proposal (RFP), if any is issued. Responses to this notice are not offers and cannot be accepted by the U.S. Government to form a binding contract. Interested parties should have current registration in the System for Award Management (SAM) database at https://www.sam.gov/. See attached Statement of Work for requirements details. The U.S. Patent and Trademark Office ("USPTO"), Office of Enrollment and Discipline ("OED") is responsible for registering patent attorneys and agents to practice in patent cases before the USPTO. A candidate seeking registration to practice in patent cases before the USPTO must, inter alia, demonstrate possession of the legal, scientific, and technical qualifications necessary to enable him or her to render patent applicants valuable service. To measure legal qualifications of registration candidates, OED tests applicants to ascertain if they have the necessary knowledge of patent law, practice and procedure to provide valuable assistance to patent applicants. Approximately three thousand six hundred (3,600) examinations were administered in fiscal year 2008; approximately three thousand four hundred (3,400) examinations were administered in fiscal year 2009; approximately three thousand one hundred (3,100) examinations were administered in fiscal year 2010; approximately two thousand seven hundred (2,700) examinations were administered in fiscal year 2011, and approximately three thousand four hundred (3,400) examinations were administered in fiscal year 2012. These tests were conducted by a single contractor at sites located throughout the nation. Candidates who fail the examination may schedule a review session to review the questions answered incorrectly. These review sessions currently take place at the Alexandria, Virginia, headquarters of the USPTO. Approximately one hundred ten (110) review sessions were held during fiscal year 2012. The USPTO has a requirement for a Computer Test Administrator ("CTA") firm capable of administering computer-based patent registration examinations in the United States, District of Columbia, Guam and Puerto Rico providing review sessions by applicants who failed those examinations. The CTA firm must possess and operate a computer-based examination system with an examination registration administration function that will accommodate current and future multiple choice examinations. The computer-based examination system must also have a review session administration function that will accommodate review sessions for candidates who have failed the registration examination. Additional information concerning the registration examination is available on the USPTO Internet web site (http://www.uspto.gov/ip/boards/oed/index.jsp) and in the General Requirements Bulletin for Admission to the Examination for Registration to Practice in Patent Cases before the United States Patent and Trademark Office ( http://www.uspto.gov/ip/boards/oed/exam/grbpage.jsp ). The USPTO desires to administer the registration examination by computer in one or more locations in each state of the United States, Puerto Rico, Guam, and the District of Columbia every day except federal holidays. The registration examination may not be administered outside the United States. Services are required at no cost to the Government. The CTA collects and retains a CTA examination administration (fixed price) fee directly from candidates before the examination is administered. The CTA examination administration fee includes two components. The first portion of the CTA examination administration fee is intended to cover all costs and reasonable profit to the CTA for operating the testing centers and supporting systems for administration of the examination; the second portion is intended to cover all costs and a reasonable profit to the CTA for consultation services in developing sound, legally defensible computer-based examinations and examination forms. At the completion of the examination, the CTA will provide a written test report to the registration candidate. The associated North American Industry Classification System (NAICS) code for this acquisition 611710 - Educational Support Services. The small business size standard is $7M. The incumbent is Prometric, Baltimore, MD with offices worldwide. The current contract requirements are valued at $2.5M for a base year and four (4) one-year options. Information Submission Instructions: Interested and capable firms should submit a copy of their company capability statement in response to the RFI. DO NOT INCLUDE A COVER LETTER. The submission shall address the following: 1. Prime Company name; 2.Contact Information (POC info, corporate address, phone number and website); •3. DUNS number; •4. Business size as it relates to NAICS 611710 - Educational Support Services ; •5. SBA Business classification(s) (i.e. 8(a), Service Disabled Veteran-Owned (SDVO), Woman-Owned, Hubzone, etc.) in accordance with Federal Acquisition Regulation Part 19; •6. Any plans to team with other firms in completing this requirement; •7. Capabilities as it relates to the requirement. Responses should include brief descriptions of (1) corporate resources (test facilities and IT capabilities); (2) qualified test personnel availability: (3) past performance references of similar size, complexity, and scope. Information should be pertinent and specific. Past performance references may be from contracts where the vendor served as either the prime contractor or as a subcontractor. Page Limitations: Your capabilities statement shall be limited to five (5) single-sided, single spaced, 12 point font minimum pages. Incomplete and unclear responses will not be beneficial to the market research process. Notice Regarding Solicitation: This is a request for information purposes and to identify potential sources. Questions are not encouraged at this time. Responses to this RFI are voluntary and their source shall be treated as confidential. Responses received in response to this announcement that are marked "Proprietary" will be handled accordingly.
