- FAR Clauses SCA Wage Rates This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6 and FAR 13, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. (A) The solicitation number is HSCG31-13-Q-PF7008 and is issued as a Request for Quotation (RFQ). (B) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-64. In addition the Service Contract Act (SCA) Wage Determination 2005-2051, revision 12, dated 06/13/2012 is applicable to this project and is attached. (C) This acquisition is issued as unrestricted. The associated NAICS code is 238990. (D) List CLINS, item descriptions, quantities and units of measure, (including option(s), if applicable): CLIN 00001, Crane Services, 1, JB (E) Description/Statement of Work/Specification 1. Provide a crane and operator capable of lifting 3,000 lbs with a boom length of at least 136 feet for 8 hours each day on February 20, 21 and 22, 2013 for a total of 24 hours. Lift will be required on the USCGC JARVIS located at Coast Guard Island, Alameda, CA 94501 at the Pier there. 2. Three (3) riggers will be required for the lift on February 26 and 27 for 8 hours each day for a total of 48 hours. A two person capacity man basket will be required all 3 days to facilitate the removal of equipment on the ship's yard arms. 3. Provide a crane and operator capable of lifting 25,000 lbs with a minimum boom length of 50 feet. Lift will be required on the USCGC JARVIS located at Coast Guard Island, Alameda CA. Crane service will be required from 08:00 - 12:00 February 26 and 08:00 - 12:00 February 27, 2013 for a total of 8 hours. 4. The Ship will be available for a Ship Check from 09:00 - 14:00 beginning January 22, 2013 M-F. The vendor is responsible for providing all climbing and rigging equipment to complete a successful lift, and for complying with all OSHA regulations. In addition, the vendor shall have all proper insurance and permits to operate this equipment and do this type of work near water. (F) Date(s) and place(s) of delivery and acceptance. FOB: Destination and for Dates please see Section E for the details. (G) FAR Provision 52.212-1, Instructions to Offerors-Commercial, is incorporated by reference and applies to this acquisition. Addendum to FAR Povision52.212-1 - the following paragraphs are modified or added to the provision: (b) Submission of Offers. - Modified Submit signed and dated offers to the office specified in this solicitation at or before the exact date and time specified in this solicitation. Offers may be submitted on a Standard Form 1449 or company letterhead stationery. As a minimum, offers must show- (1) The solicitation number; (2) The date and time specified in the solicitation for receipt of offers; (3) The name, address, and telephone number of the offeror; (4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary; (5) Terms of any express warranty; (6) Price and any discount terms; (7) "Remit to" address, if different than mailing address; (8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically); (9) Acknowledgment of all Solicitation Amendments, if applicable; and (10) Include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration. (c) Period for Acceptance of Offers. - Modified The offeror agrees to hold prices in its offer firm for 60 calendar days from the date specified for receipt of offers, unless another time period is specified in an amendment to the solicitation. (k) Central Contractor Registration (CCR). (NOW CALLED SAM.GOV)- Modified By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance and through final payment of any contract resulting from this solicitation. If the Offeror does not become registered in the SAM database before the date and time specified, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror. Offerors may obtain information on registration and annual confirmation requirements via the internet at http://www.sam.gov or by calling 1-888-227-2423 or 269-961-5757. (H) FAR Provision 52.212-2, Evaluation-Commercial Items, is incorporated by reference and applies to this acquisition: The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government price and other factors considered. The Government intends to award on an all or none basis to a responsible offeror whose offer conforms to the solicitation, and provides the Government with the best value. The evaluation and award procedures in FAR 13.106 apply. (I) Offerors are required to include a completed copy of FAR Provision 52.212-3, Offeror Representations and Certifications-Commercial Items, with their offer. Offerors may complete FAR 52.212-3 online on SAM.gov. An offeror must state in their offer if they completed FAR 52.212-3 online at SAM.gov (the information must be up-to-date and valid). (J) FAR Clause 52.212-4, Contract Terms and Conditions-Commercial Items, is incorporated by reference and applies to this acquisition. (K) FAR Clause 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items (JAN 2013) is incorporated by reference and applies to this acquisition. The following FAR clauses cited in Clause 52.212-5 are applicable to the acquisition: SEE ATTACHED FOR APPLICABLE CLAUSES FULL TEXT PROVISIONS 52.237-1 Site Visit Apr 1984 Offerors or quoters are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award. To arrange a site visit section E.4 in the SOW section of this solicitation. (End of provision). (L) A statement regarding any additional contract requirement(s) or terms and conditions (such as contract financing arrangements or warranty requirements) determined by the contracting officer to be necessary for this acquisition and consistent with customary commercial practices: N/A. NOTICE FOR FILING AGENCY PROTESTS (IF >$25K) It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the General Accountability Office (GAO). Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative Dispute Resolution (ADR) forum, rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the contracting officer or Ombudsman. Informal forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the cognizant contracting officer. If the contracting officer is unable to satisfy the concerns, the interested party is encouraged to contact the USCG Ombudsman for Agency Protests. Under this informal process, the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, contracting officer, and solicitation closing date (if applicable). Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the contracting officer through open and frank discussions. If the protester's concerns are unresolved, an independent review is available by the Ombudsman. The protester may file a formal agency protest to either the contracting officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency's goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103. If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. This will not preclude re-filing of the protest to meet the requirement. To be timely, protests must be filed within the period specified in FAR 33.103(e).
