- THIS NOTICE IS FOR INFORMATIONAL PURPOSES ONLY. The Centers for Disease Control and Prevention (CDC), National Center for Chronic Disease Prevention and Health Promotion (NCCDPHP), Office on Smoking and Health contemplates award of a Firm Fixed Price Sole Source Contract to American Nonsmokers' Rights Foundation, Berkeley, CA 94702. The work shall be performed at the Contractor's facility. The Period of Performance shall be a 12-month base period with four 12-month option periods for a total performance of 60 months. The North American Industrial Classification Standards (NAICS) Code is 813319. The sole source award will be conducted under the authority of FAR Part 6.302-1 only one responsible source and no other supplies or services will satisfy agency requirements. This requirement is a continuation of services already provided and is not set aside for small businesses. The contractor shall track trends in local tobacco control policies, over time. Tracking will include providing detailed quarterly reports on local ordinances: restricting youth access to tobacco products; restricting tobacco advertising; governing conditional use permits; levying local excise taxes on tobacco products; and, restricting smoking in workplaces and public places. In addition, the contractor shall provide quarterly reports on the proportion of the U.S. population covered by state and local smoke-free laws. Finally, the contractor shall provide four briefs or fact sheets on trends in selected policy topics, collaborate with CDC in preparing one journal article on local policy trends, and analyze specific provisions of local laws at CDC's request. The American Nonsmokers' Rights Foundation is the only organization that currently tracks local tobacco control ordinances on a nationwide level. No other organization tracks local tobacco control policy on a national basis, or has demonstrated the capacity to do so. The Foundation's U.S. Tobacco Control Laws Database is the only resource of its kind. The Foundation's unique capacity to perform this work stems in part from the fact that it has been doing this work since the 1980s and that it embarked on policy tracking as a spinoff of its educational and advocacy efforts. These efforts have equipped the Foundation with an unmatched grasp of local tobacco control policy issues, a historical knowledge of the evolution of policy and the specifics of local policies in communities nationwide and an extensive network of contacts who continue to provide the Foundation with timely information on new local ordinances. As a result, the Foundation is often aware of a proposed ordinance before it is adopted, and has obtained a copy of the ordinance before it takes effect. Over the years, the Foundation has also developed a carefully thought-out classification system for tracking ordinances, including mutually exclusive categories and a coding process with decision rules. The Foundation has also implemented a process to cross-check interpretations of policies and data entries in order to ensure that the information in its database is thoroughly vetted and reliable. No other organization has a comparable combination of assets. As a result, no other organization has proven capable of keeping track of local tobacco control policies nationwide, let alone interpreting and categorizing them in a consistent, standardized manner. CDC is not requesting competitive proposals and no solicitation is available. Firms that believe they can provide the services required are encouraged to identify themselves and give written notification no later than 12:00 PM Eastern Standard Time, February 8, 2013. Determination not to compete this proposed action based on responses to this notice is solely within the discretion of the Government. Respondents will assume all financial costs for preparing a response to this notice. The U.S. Government assumes no financial obligation for the preparation and distribution of prepared responses.
