- JUSTIFICATION AND APPROVAL FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 260 Industrial Way West Eatontown, NJ 07724 2. Description of Action: This proposed action is for a 12-month Firm-Fixed-Price Delivery Order (DO) to be issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) IV Government Wide Acquisition Contract (GWAC), to upgrade existing suites of brand name Autodesk software from 2012 to 2013 versions and to renew maintenance support for facilities in the VA Region 3 Office of Information and Technology (OIT). 3. Description of Supplies or Services: Autodesk design and creation suites provide VA facility engineers with the platform necessary for creating and editing engineering designs, construction plans, installation of real property and facility record drawings. The current support for the VA owned software expires on January 30, 2013, and as such, the period of performance required for the maintenance support and upgrades under this effort is January 31, 2013 through January 30, 2014. Statutory Authority: The statutory authority permitting an exception to fair opportunity is Section 41 U.S.C. 4106(c) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505(b)(2)(i)(B), entitled "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized". 5. Rationale Supporting Use of Authority Cited Above: Based on extensive market research, as described in paragraph eight of this document, it was determined that limited competition is viable among authorized resellers for the aforementioned brand name software upgrades and support. This is a brand name justification in support of FAR 11.105, Items Peculiar to One Manufacturer. The Autodesk support coverage from Autodesk, or an authorized reseller, will provide product support and new version updates to existing software. Only Autodesk, or an authorized reseller, has the proprietary rights to provide the required support for this software. The proprietary data allows only Autodesk, or an authorized reseller, to provide required patch fixes and updates which are critical to the continued functionality of the software and in turn the task completion the software facilitates. Autodesk products allow VA staff engineers to manage land, physical assets, infrastructure and facilities with greater efficiency from a single software platform. Additionally, the use of differing vendor products would severely hamper existing capabilities and require extensive re-tooling of workflow processes. Published training documents and on-the-job training tutorials would have to be re-worked which would take an extensive amount of time, resources, and funds to accomplish. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. Limited competition is anticipated for the required brand name upgrades and support. 7. Actions to Increase Competition: Although the Government is limiting competition as a result of specifying a brand name, there are multiple authorized resellers of the brand name supplies on the NASA SEWP IV GWAC. In accordance with FAR 5.202(a)(6), this effort is exempt from synopsizing since the proposed contract action is an order placed under an existing Indefinite Delivery/Indefinite Quantity contract. In order to remove or overcome barriers to competition in future acquisitions for this requirement, the Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be fully competed. 8.
