QUESTION 18: During the pre-bid conference for the rebid of the captioned solicitation on 1/25/13 it was observed that some of the contractors in attendance do not reside in, or primarily do business in, other counties or states outside the geographic area covered in the FEMA Major Disaster Declaration No. 4085-DR-NY. In order to respond to the solicitation these companies will have to partner with a small business firm located within the geographic area in order to qualify. Is this permitted? ANSWER 18: Yes QUESTION 19: If it is permissible for nonresident contractors to submit a bid, will the evaluation of the bidder's credentials be based on the resident small business contractor and its financial capabilities or on the nonresident contractor's? (which in essence will circumvent the desired outcome to award the solicitation to a small business within the geographic area). ANSWER 19: Proposals will be evaluated based on their merit. QUESTION 20: Will the ability to obtain a performance bond be based on the resident small business contractor's financial capabilities or the nonresident contractor's? ANSWER 20: No.
