- RFP Number M67854-13-R-0505 31 January 2013 Intent to Sole Source The Marine Corps Systems Command (MARCORSYSCOM) intends to negotiate a contract, on a sole source basis, with Xtreme Alternative Defense Systems (XADS), 1508 E 7th ST Anderson, IN 46012. The resultant contract will provide design, development, and production services to modify 8 existing Tarantula Counter Improvised Explosive Device (CIED) systems. The Tarantula Counter IED system utilizes a vehicle mounted generator to develop an electrical discharge to initiate or neutralize buried IEDs. This contract action will correct system deficiencies and provide system enhancements to 8 existing prototype systems and provide spares to support an operational assessment in Operation Enduring Freedom. The total estimated dollar value for this procurement is not to exceed $6M. The proposed acquisition is intended to be directed to XADS pursuant to 10 USC 2304 (c)(1) as implemented by the Federal Acquisition Regulations (FAR) 6.302-2 "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements" and Unusual and Compelling Urgency as implemented by FAR 6.302-1(a)(ii) and FAR 6.302-2. These prototype systems were originally provided to MARCORSYSCOM through a U.S. Army developmental effort and require improvements to meet critical mission requirements. The original prime contract, W9113M-05-C-0219, awarded by the Army to ITT Excelis, was awarded through competition. ITT Excelis subsequently sub-contracted to XADS to conduct technology development and XADS delivered 8 prototype systems to the Army resultant from their development efforts. These 8 systems were subsequently transferred from the Army to MARCORSYSCOM. XADS has asserted proprietary data rights to all necessary technical data for the systems, and is the sole producer of the Tarantula system. In order to meet current user requirements and delivery schedule, the systems originally delivered to the government must have improvements designed and incorporated to be suitable for deployment in a short period of time. Based on the continued development of this highly specialized equipment, award to any other source would result in substantial duplication of costs (which could not be recovered through competition) and unacceptable delays in fulfilling MARCORSYSCOM requirements (see FAR 6.302-l(a)(2)(ii)). The government only retains limited rights for the Tarantula data and technical data provided by XADS is restricted to government use and is not available for distribution in any form to any entity outside of government personnel. This notice of intent is not a request for competitive proposals.
