- SOURCES SOUGHT SYNOPSIS (not a Solicitation) The Department of Veterans Affairs, VHA, NCO19 Rocky Mountain Acquisition Center is seeking potential sources that are capable of providing "Comprehensive BRAC Analysis" provide testing for oncology-related laboratory testing and ancillary services related to test methodology, understanding results, and medal management options for VAMC patient specimen in relation to the BRCA 1 and BRCA 2 analysis and related services for VISN 19. VISN 19 locations: http://www2.va.gov/directory/guide/region.asp?ID=19 All interested firms shall submit a response demonstrating their capabilities to provide BRACAnalysis ® testing assesses a woman's risk of developing hereditary breast or ovarian cancer based on the detection of mutations in the BRAC1 or BRAC2 genes. As stipulated in FAR 15.201, responses to this notice are not considered offers and cannot be accepted by the Government to form a binding contract. No solicitation exists; therefore, do not request a copy of the solicitation. The decision to solicit for a contract shall be solely with the Government discretion. Firms responding should indicate whether they are, or are not, a small business, a socially and economically disadvantaged business, veteran owned small business/service disabled veteran owned small business or a woman owned business. The general definition of a small business is one that is independently owned and operated, is not dominated in the field of operation in which it is proposing on Veterans Administration contracts and with its affiliate. NAICS code to be used for this acquisition is 621511 Medical Laboratories (size standard $13.5M). The Government reserves the right to consider a small business set-aside based upon responses hereto for any subsequent acquisition. Respondents are further requested to indicate their status as a foreign-owned/foreign-controlled firm and any contemplated use of foreign national employees on this effort. Any information submitted by respondents to this sources sought synopsis is voluntary. This sources sought notice is not to be construed as a commitment by the Government, nor will the Government reimburse any costs associated with the submission of information in response to this notice. Respondents will not individually be notified of the results of any Government assessments. The Government's evaluation of the capability statements received will factor into whether any forthcoming solicitation will be conducted as a full and open competition or as a set-aside for small businesses, or any particular small business designation (e.g. SDVOSB, HUB Zone, 8(a), WOSB, VOSB, etc). Capabilities packages: all interested firms shall submit a capabilities package that explicitly demonstrates company capabilities-indicating how they would meet this requirement IAW Performance work statement. Performance Work Statement Network Contracting Activity (NCO) 19 VISN 19 Veterans Administration Medical CenterS (VAMC) VISN 19 DESCRIPTION/SPECIFICATIONS/PERFORMANCE WORK STATEMENT The Contractor shall provide testing for oncology-related laboratory testing and ancillary services related to test methodology, understanding results, and medal management options on NCO 19 VISN 19 VAMC patient specimen in relation to the BRCA 1 and BRCA 2 analysis and BRAC analysis Mutation. The parties acknowledge and agree that Contractor is a licensed clinical laboratory, and that the scope of services to be provided hereunder pertain to performing laboratory testing services; as such the Contractor does not have responsibility for, and does not routinely provide, direct patient management, supervision or contact. Accordingly, notwithstanding anything to the contrary contained herein, Contractor will only be responsible to provide those reasonable and customary services relating to the clinical laboratory testing services contemplated herein. 1.Contractor shall perform testing entirely upon their premises. 2.Contractor shall carry out its functions hereunder in full compliance with all local, state, and federal laws or regulations as they pertain to a licensed clinical laboratory operating in the State of Utah. 3.Contractor shall provide individual patient-chartable test result reports meeting CLIA requirements. 4.Contractor shall provide all appropriate requisition forms and unique supplies needed for specialized collection of samples, at no additional charge. 5.Notwithstanding anything to the contrary in this Agreement or otherwise, Contractor shall not release patient records that include test results, without the specific written consent to release such information as provided by the patient, to any person other than the ordering healthcare provider or designee. All patient records shall be treated as confidential so as to comply with all state and federal laws regarding the confidentiality of patient's records. This provision shall survive termination of this Agreement. 6.Contractor shall certify and ensure that all employees, officers, or agents do not use Protected Health Information (PHI) received from any NCO 19 site that would constitute a violation of any applicable provision in standards set forth in the Health Insurance Portability and Accountability Act (HIPAA). LICENSING AND ACCREDITATION-CONTRATOR 1.Shall have all licenses, permits, accreditation certificates required by law. 2.Shall be accredited by CLIA or the College of American Pathologists. Copies of all certifications and renewal certifications will be provided upon submission of a proposal to the Contracting Officer and Contracting Officer's Technical Representative (COTR). 3.Must comply with the regulatory requirements of the Health and Human Services Health Care Financing Administration. 4.Must notify the Contracting Officer immediately, in writing, upon its loss (or any of its subcontractors) of any required certification, accreditation, or licensure.
