Description
RFQ with SOO This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 of the Federal Acquisition Regulations (FAR), as supplemented with additional information included in this notice. The Government intends to award a fixed price purchase order as other than full and open competition under the statutory authority of 10 U.S.C. 2304(c) (1), Only One Responsible Source, as defined in FAR Part 6.302-1(b)(1) (ii) to Norris Cylinder Company. Offers are being requested and a written solicitation will not be issued. This opportunity is under NAICS 332420 size standards applied (500 Employees). The contract resulting from this procurement will be a firm fixed price contract. The solicitation SPE601-13-Q-0303 is issued as Sole Source procurement for a commercial item under authority of FAR Part 12, Acquisition of Commercial Items. The acquisition strategy for this procurement encompasses a negotiated procurement utilizing the best value source selection procedures identified in FAR Part 13, Simplified Acquisition Procedures, as authorized by FAR 12.203. Scope of Contract: Aerospace Energy products and related services, requires the manufacture and delivery of 30 new high pressure 6,000 psig gaseous argon cylinders that are European Union (EU) certified on an f.o.b. origin basis to support customer requirements at RAF Lakenheath. The gaseous argon cylinders shall be in accordance with Application of the European Agreement concerning the International Carriage of Dangerous Goods by Road (ADR) regulations for EU requirements, shall meet all applicable Compressed Gas Association (CGA), Department of Transportation (DOT), Code of Federal Regulations (CFR) 49, and Military Standards, and shall meet the most current edition of International Organization for Standardization (ISO) 9809-1, ISO 9809-2, and the CGA C-11 inspection requirements. The Government will only accept new containers. Once constructed, each gaseous argon cylinder will be charged with a gaseous nitrogen blanket at a pressure not to exceed 29.0 psig. Estimated delivery is on or about 1 May 2013. Cylinders shall be ready to be filled with high pressure gaseous argon as specified herein. The following provisions and clauses apply to this acquisition: FAR 52-212-1, Instructions to Offerors Commercial Items; 52.212-2 Evaluation of Commercial Items; the evaluation criteria stated in paragraph (a) of the provision are as follows: Both a Price Proposal and a Past Performance is required to be submitted, but the Past Performance record will only be analyzed in conjunction with responsibility determinations, not technical capability. Price will be the only factor available to differentiate offerors in the source selection process and as such, price will be the only evaluated factor. 52.212-3 Offeror Representations and Certifications Commercial Items; 52.212-4, Contract Terms and Conditions Commercial Items and 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive orders - Commercial Items. In paragraph (b) of 52.212-5, the following apply: FAR 52.203-6, 52.204-10, 52.209-6, 52.219-8, 52.222-3, 52.222-19, 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.222-40, 52.223-18, 52.225-13, and 52.232-33. In paragraph (b) of 252.212-7001, the following apply 52.203-3, 252.203-7000, 252.225-7021, 252.232-7003, 252.243-7002, and 252.247-7023.
