Description
DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Program Contracting Activity East - St. Louis VA Medical Center, Bldg. 2 #1 Jefferson Barracks, Drive St. Louis, MO 63125 777-12-4-6192-0331 2.Nature and/or Description of the Action Being Processed: EES Media Services plans to request for a new requirement using FY 12 funding by means of other than full and open competition for a Firm Fixed-Price contract. The proposed awardee is Tektronix. 3.Description of Supplies/Services Required to Meet the Agency's Needs: EES Media Services requires factory service to repair a Tektronix WFM 7120. Tektronix built this unit which is used in studio productions for live and to tape programing. The repair and maintenance, includes all parts and labor necessary to return the products to the original published specifications The estimated cost of this proposed acquisition is $ 3,475.00. This is a Onetime service contract. 4.Statutory Authority Permitting Other than Full and Open Competition: ( ? ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1 (ii) 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): a. Only One Responsible Source (FAR 6.302-1 (ii) Tektronix built the equipment and are the only authorized vendors that could be located to provide the required service to get the equipment back to the original published specifications. To replace this with another unit from a different vendor would mean we would have to replace the equipment. This would be a very cost prohibitive as new piece of equipment would cost $11,900. The cost difference of $8425.00 for the repairing of the existing unit compared to buying new equipment cannot be recovered through competition. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Tektronix was the only vendor found that could provide the required services. The acquisition will not be synopsized in FedBizOpps as it is less than $25K. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The price offer to the government is same price offered to the commercial marketplace. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: A search of Google, GSA, SBA and VetBiz was conducted for small business concerns. Numerous vendors were contacted from GSA and VetBiz and none were able to provide required services. The market research concluded that vendor is the only authorized repair shop for this equipment. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: The costs and time associated for reproducing the system using other vendor equipment are cost and time prohibitive. Thus, this contract is needed to maintain an essential capability that supports education programs for EES Media Services. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required None as this is a factory repair. 12.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
