- The U.S. Food and Drug Administration (FDA) Office of Acquisitions and Grants Services (OAGS) in Rockville, MD intends to award a contract to the National Cyber-Forensics and Training Alliance in Pittsburgh, PA for Internet Monitoring under the authority of Federal Acquisition Regulation (FAR) Part 15, Contracting By Negotiation. In monitoring the illicit trafficking and marketing of FDA-regulated items on the internet, FDA requires a contractor to provide internet analysis support services to assist FDA in identifying illegal marketing and/or sale of FDA-regulated products via the internet. These products include prescription drugs, dietary supplements, tobacco, medical devices, blood and biologics, vaccines, cosmetics, radiation-emitting products, animal and veterinary medicines and foods. The contractor will be required to provide relevant data and statistical information on internet entities in the form of informational requests, de-confliction services and also perform straw purchases. FDA will use this information to assess resource allocation for particular investigation, understand the scope of the rogue online pharmacy industry, generate additional investigative leads, identify violators, coordinate and de-conflict information internally and with other law enforcement agencies and private sector corporate security personnel. FDA requires that these activities be performed in a FBI-cleared facility with personnel who have obtained security clearances (LBI) in order to preserve and protect the evidentiary chain of custody. In addition to secured facilities and personnel, FDA requires that any contractor have an extensive array of information that has come from reliable law enforcement and industry sources. Based on our market research, the National Cyber-Forensics and Training Alliance is the only known source to meet our requirements. NCFTA has the capabilities to provide internet monitoring of the internet, as well as data mining using their proprietary Tirion database and other investigative information gained through their in-house law enforcement and industry sources to capture data required by FDA. FDA is unaware of any other vendors who have law enforcement personnel collaborating from multiple law enforcement entities co-located at the same physical location. In addition to this, FDA is unaware of any other entity that has access to intelligence from other law enforcement/industry sources and that performs de-confliction services with the resources available to NCFTA. The period of performance for this requirement is from date of award through March 30, 2018. The NAICS code is 541512 and the size standard is $25.5 million. This notice of intent is not a request for competitive quotations and no solicitation document is available. However, any firm that believes it can meet these requirements may give notification to the Contract Specialist by 8:00 a.m. local time on March 3, 2013. Interested firms must furnish supporting evidence with sufficient detail to demonstrate its ability to comply with the requirement described above. The FDA will review all responses received; however, the Government retains the sole discretion not to further compete the proposed acquisition based on responses to this notice.
