- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (Granite Engraving Service) (January 22, 2013) 1. AGENCY AND CONTRACTING ACTIVITY: NATIONAL PARK SERVICE Little Bighorn Battlefield National Monument P.O. Box 168 Yellowstone National Park, WY 82190 307-344-2149 Contracting Officer: Andy Fox 2. NATURE OF ACTION: Requesting approval to use other than full and open competition procedures for: The engraving twelve granite panels with interpretive media. The granite panels are mounted within the Native American Memorial site at Little Bighorn Battlefield National Monument. 3. DESCRIPTION: The contractor will be required to prepare templates from government provided graphics for each of the twelve granite panels at the Native American Memorial site. The contractor will be required to transfer the template graphic on to the surface of the granite panels through carving, engraving, sandblasting, and etching techniques on site without removing panels from existing mounting. The contractor will be required to prepare a total of twelve etched granite inlays, prepare voids in the granite panels to receive these inlays and install the inlays. Estimated value range is $150,000 - $500,000. 4. AUTHORITY: 10 U.S.C. 2304(c)(1) as stated in FAR 6.302-1 Only one responsible source, Chevo Studios, Inc. 3222 Tejon Street, Unit H, Denver Colorado 80211, and no other vendor will satisfy agency requirements. 5. PROPOSED CONTRACTORS UNIQUE QUALIFICATIONS (FAR 6.303-2(a)(5)): Chevo Studios stone artist Andy Dufford is uniquely qualified to execute this project due to his extensive experience facilitating the final panel designs, integrating Native American perspectives, his unique and distinctive approach to artistic design, and handcrafted stonework to create public spaces. Mr. Dufford worked closely with the seventeen (17) Native American tribes and two (2) families honored through the Indian Memorial during the pre-fabrication process and developed the artistic vision and created the final panel designs. Mr. Dufford and his colleagues at Chevo Studios have both the technical expertise to execute the complex designs into granite and the artistic conception to bring the Indian Memorial to completion as a thought provoking public space with integrated art elements that honor the architecture of the original Indian Memorial design concept and that place the Indian Memorial in the context of the overall battlefield landscape. No other contractor can provide the unique and critical combination of artistic expression, implementation of tribal perspectives, and technical execution thereby justifying the need for a sole source follow-on contract to ensure the successful completion of this project. 6. DESCRIPTION OF EFFORTS TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS PRACTICABLE (FAR 6.303 2(a)(6)): This requirement could not be solicited to any other vendors as the requirement is for the engraving of twelve granite panels at the Native American memorial at Little Bighorn Battlefield National Monument. No other vendor is available to solicit for specialized granite engraving and as stated above. A notice of intent to award sole source will be publicized as required by FAR 5.207(a)(14). 7. ANTICIPATED COSTS TO THE GOVERNMENT/ FAIR AND REASONABLENESS (FAR 6.303-2(a)(7)): A separate determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. 8. MARKET RESEARCH (FAR 6.303-2(2)(8)): Extensive research was accomplished which no other feasible sources were found. Due to the complexity and overall value of this acquisition, Chevo Studios, Inc. was found to be the exclusive source for the requirement. 9. OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION (FAR 6.303-2(a)(9)): Chevo Studios, Inc is the only available source for this requirement. Twelve granite panels are currently installed at the Native American Memorial. The granite panels are 10 inches thick, 44 inches high and have a curved face ranging in width from 78 to 91 inches. If the engraving is not acceptable, replacing the granite panels would cost in excess of one million dollars. It is essential that the contractor have a proven track record along with the understanding and ability to transfer the artist design to the granite panels. Andy Dufford of Chevo Studios was intimately involved in the development and presentation of the final concepts for the Indian Memorial and participated actively in tribal consultation meetings on site at LIBI, at tribal government headquarters, and via telephone with designated tribal representatives. The ability for the NPS and tribes to concur on the final, pre-fabrication panel designs was due largely to the ability of Mr. Dufford and the Chevo Studios team to translate the visions of the tribal representatives into granite as a medium. The project discussions included culturally sensitive information that is not typically shared with contractors. Mr. Duffords background in public art projects, landscape architecture, and artistic stone rendering enabled him to enhance the overall goal of the project while honoring the individual preferences and unique perspectives of each participating tribe and family. This fact, combined with the fact that Chevo Studios via Andy Dufford is the only possible source for the unique combination of multi-faceted skills that the project necessitates, makes competition unfeasible. 10. ACTION, IF ANY, BEING TAKEN TO REMOVE AND OVERCOME BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED (FAR 6.303-2(A)(11)): Harpers Ferry Center has indicated that Chevo Studios was the only contractor that was willing to assume the complexity and nature of this project along with the responsibility of engraving on existing granite.
