Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the ONLY solicitation and no other solicitation document will be issued. This solicitation is issued as a Request for Quote number RFQ HSCG44-13-Q-PCZ396. This number is for tracking purposes only. Solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 05-65. This procurement will be processed in accordance with FAR Part 12. The North American Industry Classification System (NAICS) is 334515. The SBA size standard is 500 EMP. This is Not a Small Business Set-Aside, due to this acquisition being a Sole Source Procurement it is not anticipated that there will be 2 or more qualified Small Business Concerns to provide pricing for this requirement IAW 19.502(a). The USCG Command Control and Communications Engineering Center (C3CEN) Portsmouth. Va. 23703 intends to purchase on a non-competitive basis by awarding a Firm Fixed Price Purchase Order Contract to DiagnoSys Systems Inc. Cage Code: 042A6, an Annual Maintenance Agreement for Schlumberger S645 System Circuit Cards, a Base Period of Performance (POP) of one (1) year with the option of four (2) one year options IAW Statement of Work. This purchase is for USCG C3CEN Electronic Repair Facility, 2401 Hawkins point Road, Baltimore, MD 21226. The Coast Guard does not own nor can they obtain specifications or other technical data for these Services. Requests for drawings and specifications will be disregarded. The proposed contract action resulting from this synopsis/solicitation for commercial services is the Governments intention to solicit and negotiate with only one source under the authority of FAR 6.302-1 & 13.106-1(b). Interested persons/parties may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive quotations/proposals. However, all quotations/proposals received within 5 days after date of publication of this synopsis/solicitation will be considered by the USCG/Government. Any Contractors that are authorized by DiagnoSys Systems Inc to conduct Maintenance are encouraged to provide a Firm Fixed Price. A determination by the USCG/Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the USCG/Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement, and for informational purposes for future acquisitions. The contractor for this proposed Sole Source contract is: DiagnoSys Systems Inc. Cage Code: 042A6. A SAMS/BINCS Contractor Verification Information search was conducted on Feb/19/2013 by the Contracting Officer listed below. This is Considered to be a Sole Source Acquisition. See attached Justification for Other Than Full and Open Competition (JOTFOC) Document below. Schedule B Annual Maintenance for the Schlumberger S645 System Circuit Cards, three (3) Units S/N's 48, 79, & 128 Line Item 1: Base Period: Base Year, Start: 3/1/2013 End: 2/28/2014 _________________ Line Item 2: Option Year 1: Start: 3/1/2014 End: 2/28/2015 _______________________ Line Item 3: Option Year 2: Start: 3/1/2015 End: 2/28/2016 ________________________ NOTE: The Government is not obligated nor required to Exercise any Option Period of the awarded contract. The government intends to award a contract resulting from this solicitation to the responsible bidder proposal conforming to the solicitation which will be most advantageous and BEST VALUE to the Government, price and other factors considered. *PLEASE NOTE* Interested Offeror's are to provide Firm Fixed Price Proposals IAW Statement of Work by FEB/26/2013 @ 8:00AM EST. The Anticipated Award Date for the Purchase Order Contract is FEB/27/2013; this date is approximate and not exact. Evaluation of options will not obligate the Government to exercise the option(s). (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 36 months. The Following FAR Provision applies to Line Item 2-3 only of this Acquisition: FAR 52.232-18 Availability of Funds Funds are not presently available for this contract. The Government's obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer. End of Clause Statement of Work 1.0 GENERAL The U.S. Coast Guard Command, Control and Communications Center, Electronics Repair Facility (C3CEN ERF) provides Depot support for legacy 378' class MPCS (Main Propulsion Control Systems), 110' Propulsion Control and Auxiliary Systems. The ERF utilizes highly specialized Schlumberger J S645 Automated Test Equipment (ATE) systems to effect repair and support of electronics circuit cards. 2.0 REQUIREMENTS 2.1 Scope The scope of this requirement is to obtain maintenance and repair services for three Schlumberger S645 ATE Console Systems operated and owned by C3CEN-ERF located at 2401 Hawkins Point Road, Baltimore Maryland 21226. The offeror upon award by the contracting officer shall provide quality repaired/replacement system(s), assemblies, sub-assemblies, electronic circuit card(s) and or parts to the C3CEN ERF in support of the three ATE systems. 2.2 Description 1. C3CEN ERF is looking for a repair and support agreement for one base year with the possibility of 4 option years for a Schlumberger S645 Automated Test Equipment System, Serial Numbers 48, 79, & 128. 2. Offeror shall provide a flat rate price for each system(s), assemblies, sub-assemblies, circuit card(s) and or part(s) repaired/replacement. 3. For this fixed, monthly fee, the USCG intends to turn in items for inspection/repair and receive a repaired/replacement back within 5 days. 4. Parts shall be shipped to the USCG C3CEN ERF. 5. Offeror shall provide a Not to Exceed price for repairs that may be caused by negligence, willful abuse, fire, accident or abnormal cause. 6. Offeror will warranty their work, replacement system(s), assemblies, sub-assemblies and or part(s) against defects caused by poor workmanship or defect by the offeror. 7. Repairs shall be accomplished in accordance with OEM Standards and Procedures. 8. Offeror shall provide a copy of their warranty terms with their quotation. 3.0 PERIOD OF PERFORMANCE The base period of performance for this requirement shall be 12 months from 3/1/13 with the option to extend an additional 2 years. 4.0 GOVERNMENT FURNISHED PROPERTY By exchange basis only. The government will exchange defective system(s), assemblies, sub-assemblies and or part(s) in exchange for quality repaired system(s), assemblies, sub-assemblies and or part(s). 5.0 SHIPPING, HANDLING AND RECEIVING Shipment of systems, assemblies, sub-assemblies, electronic circuit cards and or parts will be shipped in the most expeditious manner possible. Offeror will incur the cost of shipping, packaging and handling for material originating from the offerors location. All material shipped to the US Coast Guard Command Control and Communications Center, Electronics Repair Facility must be accompanied by an itemized packing list securely attached to the outside of the package: USCG C3CEN Electronic Repair Facility, 2401 Hawkins point Road, Baltimore, MD 21226 All packing lists shall cite the Purchase Order Number (when issued after award) with the package in such a manner as to provide identification. Material shall be packed for shipment in such a manner as to afford adequate protection to the item against corrosion, deterioration and physical damage during shipment from the supply source to the C3CEN ERF. Package shall also provide adequate protection for warehouse storage and multiple shipments. All packages shall have the Purchase Order Number, Stock Number and Vendor name and Part Number clearly marked on the exterior of the package. All deliveries are to be made Monday through Friday between the hours of 7:30 A.M. and 3:30 P.M. 6.0 CONTRACTOR FURNISHED PROPERTY The Contractor shall furnish all facilities, equipment and items necessary to satisfy contract requirements except for Government Furnished Property. 7.0 SECURITY CLEARANCE The work will not be classified. No security clearance is required. 8.0 REFERENCES 1. See JOTFOC Below Justification for Other Than Full And Open Competition 1. Agency and contracting activity: The Department of Homeland Security, U.S. Coast Guard Command, Control and Communications Engineering Center (C3CEN). 2. Nature/description of the action being approved: The U.S. Coast Guard C3CEN Electronics Repair Facility (ERF) has a requirement, on a sole source basis, for a maintenance and repair agreement in support of legacy Schlumberger S645 Automated Test Equipment (ATE) Systems that are utilized in Centralized Depot repair within the Electronics Repair Facility. The Procurement Branch, C3CEN, Portsmouth, VA will award the contract. 3. Description of supplies/services: A Purchase Request will be issued for the purchase of: one base year (12 month) service and repair agreement with the possibility of four option years. Offeror to provide quality repaired /replacement system(s), assemblies, sub-assemblies, circuit card(s) and or part(s) to the ERF in support of three Schlumberger S645 systems. Total Estimated Value (Base + 2 Options): $105.000.00 4. Identification of the justification and the rationale: This statutory authority permitting other than full and open competition is 10 USC 2304(c)(1) implemented by FAR Subpart 6.302-1, entitled "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements". 5. Demonstration that the nature of the acquisition requires use of authority cited: Schlumberger Inc. no longer supports the Schlumberger S645 ATE system and has sold all rights, technical information, schematics, drawings and resources to DiagnoSYS Inc. DiagnoSYS Inc. maintains proprietary rights to the Schlumberger S645 ATE system and is the only known provider that can meet minimum quality assurance standards set by the US Coast Guard. Any variances could adversely impact the ERF's ability to meet USCG minimum safety requirements and ensure mission performance. 6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable: A Request for Quotation (RFQ) will be posted on FedBizOps with the statement Any Contractors that are authorized by DiagnoSys Inc to conduct Maintenance are encouraged to provide a Firm Fixed Price 7. Determination by the Contracting Officer that the anticipated cost to the government will be fair and reasonable: The Contracting Officer will determine price fair and reasonableness based on previous purchases of the same or similar items IAW FAR 13.106-3. 8. Description of Market Research: Market research as prescribed in FAR Part 10 was conducted by the Contracting Officer's Representative. The Internet was searched using the technical information required for Schlumberger S645 systems and associations. The market research showed that DiagnoSYS Inc. is the only known provider with the technical ability and proprietary rights to specialized equipment, schematics, technical specifications and drawings for providing service adequate to meet the minimum quality assurance standards for Schlumberger S645 ATE systems. 9. Any other facts supporting the use of other than full and open competition: The ERF has invested over $150,000.00 dollars in previously purchased Schlumberger S645 Systems. In addition, the technical specifications and supplementary data are proprietary to the DiagnoSYS Inc. and cannot be provided to other providers. The alternative would be to change to another system which would not be cost effective. 10. Listing of sources, if any, that expressed, in writing, an interest in the acquisition: None At This Time. 11. Statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisitions for supplies or services required: None At This Time 12.
