- SECHQ113R0007 Pricing Schedule This is a combined synopsis/solicitation for commercial items prepared for the purchase of transit vouchers in support of the U.S. Securities and Exchange Commission Philadelphia Regional Office (SEC PLRO), as detailed below, in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation number is SECHQ113R0007 and is issued as a request for proposal (RFP). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-65. The NAICS code associated with this procurement is 541990, All Other Professional Services, with a small business standard size of $14,000,000. This is not a small business set-aside. The contractor shall provide transit check vouchers to be utilized for Southeastern Pennsylvania Transportation Authority (SEPTA), Port Authority Transit Corporation (PATCO), and New Jersey Transit (NJ Transit) in a variety of increments as requested by the SEC PLRO. The Contractor shall mail transit check vouchers no later than 24 hours from the date the request is received. The contractor shall provide vouchers in the following amounts at a minimum: $15, $20, $30, $35, $60, and $65. Additional increments are encouraged. The contractor shall provide vouchers with a minimum expiration date of fifteen months from date of issuance. In the event the voucher expires, the contractor shall provide the SEC with a replacement voucher free of charge. Respondents shall follow the contract line item number (CLIN) structure detailed in the attached schedule. The Period of Performance is for a base year and four option years. The vouchers shall be delivered to The Mellon Independence Center, 701 Market Street, Philadelphia, PA 19106-1532, FOB Destination. All questions regarding this notice shall be directed to Takela Morris, Contract Specialist at morrist@sec.gov no later than 5:00 PM Wednesday March 6, 2013. The following FAR provisions apply: 52.212-1 Instructions to Offerors (Feb 2012) applies to this acquisition. Offerors are required to submit existing product literature that clearly describes the company's technical capability to meet the requirements indicated in the solicitation. Offerors must also submit price proposals in the format of the attached pricing schedule. All proposals must be for all contract line items, as stated. Partial proposals will not be considered. 52.212-2 Evaluation of Commercial Items (Jan 1999) applies. The Government will award an indefinite delivery, indefinite quantity contract with firm fixed pricing resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation, will be most advantageous to the Government, considering technical capability and price. Award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for the technical capability factor. Offerors must submit a completed copy of the provision at FAR 52.212-3 Offeror Representations and Certifications -- Commercial Items (Dec 2012) with its offer unless the offeror has Representations and Certifications entered into the ORCA database at https://www.acquisition.gov/far/. Offerors that fail to furnish the required representation information, or reject the terms and conditions of the combined synopsis/solicitation, may be excluded from consideration. Evidence of valid CCR registration must be obtained before award can be made; 52.239-1 Privacy or Security Safeguards (Aug 1996); 52.217-8 Option to Extend Services (Nov1999); and 52.217-9 Option to Extend the term of the Contract (Mar 2000) are also included by reference. 52.216-19 Order Limitations (Oct 1995) (a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $2,500, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract. (b) Maximum order. The Contractor is not obligated to honor- (1) Any order for a single item in excess of $175; (2) Any order for a combination of items in excess of $300,000; or (3) A series of orders from the same ordering office within 30 days that together call for quantities exceeding the limitation in paragraph (b)(1) or (2) of this section. (c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section. (d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 10 days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source. (End of clause) 52.216-22 Indefinite Quantity (Oct 1995) (a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract. (b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the "maximum." The Government shall order at least the quantity of supplies or services designated in the Schedule as the "minimum." (c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations. (d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that order to the same extent as if the order were completed during the contract's effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after three years of award of contract. (End of clause) As referred to in paragraph (b) of FAR Clause 52.216-22, "Indefinite Quantity" of this contract, the contract minimum quantity is establish at $2,500. The contract maximum quantity is hereby established at the total amount of $300,000.00.
