- Pursuant to the authority at FAR 6.302-1, the Department of Health and Human Services, Program Support Center (PSC) intends to negotiate on a sole sources basis with West Publishing Corporation, 610 Opperman Drive, Saint Paul, MO, 55123, for access to Westlaw, an on-line database, to assist OGC with their legal research needs. The term of the award will be a base period of April 1, 2013 through September 30, 2013 and four one year option periods. West Publishing Corporation is the only provider and developer of the Westlaw Database. Therefore, is the only responsible source to provide the necessary access to support OGC's mission. The purpose of this acquisition is to assist the Department of Health and Human Services, Office of the General Counsel (OGC) with its legal research needs. This requirement is for access to the Westlaw online database for: 1. CJS: Corpus Juris Secundum legal encyclopedia; 2. Tribal Law: Includes access to Native American case law, codes, constitutions, and court rules, as well as expert analytical and news resources; 3. Health Care Analytical: Includes pertinent healthcare related handbooks and guidebooks, including in the areas of Medicare, Medicaid, FDA, and patient care; 4. WL SO JURY VERDICT LIB ADDON: Provides access to jury verdicts/settlement statements; 5. WL SO PASTSTAT LOCATOR USCA ADDON: PastStat Locator USCA-which are databases with former versions of the United States Code Annotated; 6. WL SO REGULATIONS PLUS ADDON: RegulationsPlus and StatutesPlus are two proprietary databases on Westlaw that find and analyze federal regulations and statutes to determine if they are valid, which includes court case interpretations; 7. WL SO SUTHERLAND STATUTORY CONST ADDON: Sutherland's on Statutory Construction-recognized as a core text on statutory construction by the American Bar Association; 8. WL SO MULTI JURIS GRAPHICAL STAT ADDON: Graphical Statutes, another Westlaw-only database, charts legislative changes and links related documents in an easy-to-read display; 9. WL SO MEDICAL LITIGATOR PREM ADDON: Provides one-stop access to authoritative medical/legal information to help attorneys gain a deeper understanding of medical issues; 10. WL SO RESULTSPLUS ADDON: Provides relevant suggestions to relevant analytical content and to West Key Numbers; 11. WL SO PROFILER ALL ADDON: Provides access to expert witness investigation reports, attorney/judge profiles, and profiler litigation history reports; 12. WL SO CITEADVISOR ADDON: CiteAdvisor automates citation formats and builds table of authorities for court briefs; and 13. WL SO GOVT CONTRACT NEWSLTR ADDON/WL SO GOVT CONTRACTS COUNSELOR ADDON: Westlaw provided OGC a customized Government Contracts Counselor tab, which provides the OGC General Law Division Employment Law attorneys with a single page that displays relevant case law, administrative materials, analytical treatises, and news and periodicals, relevant to the area of law. In accordance with FAR 5.207(c)(16)(ii), vendors that feel they can meet the Government's requirement detailed above may submit a capability statement which shall be considered by the agency. A determination by the Government not to open the requirement to competition based on responses to this notice is solely within the discretion of the Government. The preponderance of the required items are available under the General Services Administration (GSA) Federal Supply Schedule. The Government anticipates that the acquisition will be conducted in accordance with Federal Acquisition Regulation (FAR) Subpart 8.4, Federal Supply Schedules. Award of a firm-fixed price delivery order is anticipated. The North American Industry Classification System (NAICS) code for this requirement is 519120. The small business standard is 14.0M. This is not a solicitation for competitive response. A solicitation is not available. Closing date is March 22, 2013 at 2:00 PM Eastern Standard Time.
