Description
The purpose of this amendment is to provide additional clarification to question #42 in the Presolicitation Conference Summary dated 05 March 2013 (see page 14 of 25). Refer below: 42. On similar solicitations the Department has precluded quality assurance and IV&V contractors from teaming and or priming work that they are auditing due to a conflict of interest. Is the company that is currently conducting quality assurance for ERIC able to participate as a prime or as a teaming partner? The Department's response: No small business currently performing work on ERIC is prohibited from teaming or serving as the prime contractor. The prime contractor (large or small) working on ERIC is prohibited from teaming with a small business partner. As a means to provide further clarification, let it be known that the Department is competing requirement erte10038b through a total small business set-aside. Therefore, the proposed prime contractor for erte100038b must be a small business. Partnering or teaming between two firms for erte100038b is allowed; however, the firms that are partnering or teaming must be small businesses. With regard to large businesses, a large business cannot compete for erte100038b as a prime contractor due to this requirement being set-aside for small businesses. A large business can only be a subcontractor to a small business for this requirement on the condition that (1) the small business must perform at least 51 percent of the work in accordance with FAR 52.219-14, and (2) the proposed large business subcontractor cannot perform more than 49 percent of the work required in the PWS.
