Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1. Identification of Agency and Contracting Activity. This Justification and Approval (J&A) for Other Than Full and Open Competition is executed by the Department of Veterans Affairs (VA), Acquisition Service-Frederick (AS-F) for Veterans Benefits Administration (VBA), Vocational Rehabilitation and Employment Service (VR&E). 2. Nature/Description of Action being Approved. This activity proposes to negotiate a noncompetitive award (sole source) with Standard Communications, Inc (a Service-Disabled Veteran-Owned Small Business) for the procurement of business process reengineering support services. 3. Description of Supplies/ Services Required to Meet the Agency's Need (including estimated value). This requirement is to continue the work begun during the VR&E Business Process Reengineering (BPR) Services Contract. The BPR Services Contract is working toward improving VR&E's use of automation, provision of services, and personnel performance. All deliverables associated with this task order will be Section 508 (part of the Rehabilitation Act of 1973, as amended in 1998) compliant. This requirement will allow for the following: A.Expansion of the staffing model to include beta testing and familiarization, new requirements, implementation of new requirements, training, and a user guide; B.Preparation and development of rehabilitated and discontinued Veterans post-outcome questionnaires; implementation strategy/approach recommendations that will result in electronic and paper based questionnaires being automatically sent to Veterans at the six and twelve month milestone dates as well as recommendations for a system for managing the responses that are returned (via electronic and paper submissions) from the Veterans' completed questionnaires and following up with Veterans, who have not completed the questionnaires; recommendations for electronic questionnaire packages and providing the associated general budgetary requirements/rough cost estimates; and recommendations for types of report, analysis, and the process for tracking and report development at the national, regional office, and counselor levels. C.Provision of a Contractor's Project Management Plan (PMP) and project management support to ensure the timely successful completion of this TO and its associated tasks and deliverables. The Contractor shall provide continuation of services that are critical to VBA's Business Transformation and ensure VR&E Service's required tasks align with the core area requirements of BPR. The required tasks are a continuation of BPR improvements, and implementation supports VBA's Business Transformation. The major task areas are as follows: A.Staffing Model and Enhancements; B.Case Management Post-Outcome Rehabilitated and Discontinued Veterans Questionnaires and Follow-Up; C.Contractor's PMP and Project Management Support. VA desires to meet the following objectives for implementing the continuation of BPR improvements in support of VBA's Business Transformation efforts. All deliverables associated with the objectives for implementing the continuation of BPR improvements will be Section 508 compliant. The proposed total contract cost is estimated to be $818,011.65. 4. Identification of Statutory Authority Permitting Other than Full and Open Competition. The statutory exception permitting other than full and open competition for this acquisition is 41 USC 253(c)(5), Authorized or Required by Statute as implemented by FAR 6.302-5. The applicable statute is PL 109-461, Veterans First Contracting Program (codified at 38 U.S.C. § § 8127 and 8128). 5. Demonstration of Contractor's Unique Qualifications. Standard Communications, Inc. (SCI) is a VA Certified Service Disabled Veteran Owned Small Business. SCI's capabilities include "total life cycle" program management services; telecommunications and infrastructure services (strategy, design, engineering, acquisition, implementation, operations, and maintenance; inside/outside cable plant design and installation as well as perimeter security solutions; and telephony expertise); information technology services (functional expertise in systems development, engineering, document management - imaging/digitalization, and implementation through every phase of the information technology life cycle); data transmission circuits services; and program management and contract administration support services. VA has been a major customer of SCI. In 2004 - 2005, SCI installed private business exchanges (PBXs), complex communications/IT/training projects, at VA Medical Centers in Manchester, NH; Boston, West Roxbury, Brockton, MA and the Out Patient Clinics (OPCs) in Lowell and Worchester, MA. From 2005 - 2006, a similar project was done for the VA at the VAMCs in Battle Creek, Saginaw, and Ann Arbor and at the OPC in Grand Rapids and ten other sites in Michigan. These new communications facilities were then integrated with the existing VAMCs at Indianapolis, Ft. Wayne, and Marion, IN; Detroit, MI; and Danville, IL. Additionally, starting from 2006, SCI was awarded the Veterans Technology Services (VETS) government-wide acquisition contracts (GWAC) for both functional areas: Systems Operations and Maintenance and Information Systems Engineering. Further, SCI had communications projects at the VAMC in Northampton, MA; Sheridan, WY; Murfreesboro, TN; Salisbury, NC, and Richmond, VA in 2007 - 2008. Also, in 2007, SCI provided help desk and other support services to the VAMCs and OPCs in Kansas and Missouri. In 2009, SCI assisted the VA's Austin Finance Center with the installation of the first NEC SV8500 100% Voice over Internet Protocol. More specifically to VR&E Service, SCI assisted with the CWINRS Project Office in Washington, DC. 6. Description of efforts made to ensure offers are solicited from as many potential sources as practicable. Not applicable per VAAR 819.7007(b). A notice of intent will be posted to the Federal Business Opportunities System. 7. Determination of Fair and Reasonable Prices. No award shall be made until the Contracting Officer determines the costs to the Government to be fair and reasonable. This determination will be based on sources such as comparison of other contracts' for same or similar services, the contractor's public price list, GSA price lists, and other market research. 8. Description of Market Survey. Not required per VAAR 819.7007(b). Market research was conducted using VetBiz.gov. Accord Federal Services, LLC is a responsible source with respect to this contracting opportunity. It is registered and verified in VetBiz.gov as a SDVOSB with the NAICS code for this requirement. 9. Other facts supporting the use of other than full and open competition. PL109-461 Section 502(c) states: SOLE SOURCE CONTRACTS FOR CONTRACTS ABOVE SIMPLIFIED ACQUISITION THRESHOLD. For purposes of meeting the goals under subsection (a), and in accordance with this section, a contracting officer of the Department may award a contract to a small business concern owned and controlled by veterans using procedures other than competitive procedures if: (1)Such concern is determined to be a responsible source with respect to performance of such contract opportunity; (2)The anticipated award price of the contract (including options) will exceed the simplified acquisition threshold (as defined in section 4 of the Office of Federal Procurement Policy Act (41 U.S.C. 403)) but will not exceed $5,000,000; and (3)In the estimation of the contracting officer, the contract award can be made at a fair and reasonable price that offers best value to the United States. It is anticipated that this procurement will meet all of these conditions. 10. Listing of Interested Sources. Standard Communications, Inc 5402 Leeds Manor Rd. Hume, VA 22639-1758 (SDVOSB) 11. Actions Taken to Remove Barriers to Competition. All future requirements will be handled on a case-by-case basis. Market research will be conducted at that time to determine if a more cost effective/ efficient system would better meet the evolving needs to the organization.
