- The U.S. Army Contracting Command-New Jersey on behalf of the Office of the Project Manager, Soldier Weapons (PM SW) has a requirement to procure M25 Stabilized Binoculars, NSN: 1240-01-410-7418, Part Number 12961237 and intends to solicit and negotiate on a sole source basis to Fraser Volpe Corp. located at 1025 Thomas Drive Warminster, PA 18974. The statutory authority permitting other than full and open competition is 10 U.S.C. 2304 (c) (1) as implemented by FAR 6.302-1 (b)(1)(ii) - Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, Unique Supplies or Services. The M25 is a hand held, lightweight, internally stabilized binocular, with laser protection, a military grade reticle, and a rubber or other non-slip coating. The M25 provides users with a high power stabilized binocular with the capability to do target identification and battle damage assessment during day and night operation at extended ranges (2000-4000m). The M25 is hardened against lasers and against natural and man-made environmental conditions per the U.S. Army M25 Purchase Description. Laser protection of the M25 is in accordance with the classified secret addendum (which requires a SECRET Clearance with the Security Office) to the purchase description. The contractor will be responsible for the manufacturing, inspection, packaging, testing, and delivery of the M25. A five (5) year IDIQ contract with a minimum quantity of 350 and a maximum quantity of 3253 each binoculars is being projected. Furthermore, the M25 Purchase Description is marked with a quote mark Distribution X quote mark restricted by the Arms Export Control Act (Title 22, U.S.C., Sec 2751, et seq.) or the Export Administration Act of 1979 (Title 50, U.S.C., App. 2401 et seq), as amended. Violations of these export laws are subject to severe criminal penalties. A signed and approved DD Form 2345 Military Critical Technical Data Agreement along with a completed and signed AMSTA-AR Form 1350 Technical Data Request Questionnaire and a U.S. Government Non-Disclosure / Non-Use Agreement is required.
