- Sole Source Justification for limiting competition to Pritchett Controls, Inc. The Department of Facilities (FAC) at the Uniformed Services University of the Health Sciences (USUHS) located on the Naval Support Activity in Bethesda, MD has a requirement for continued on-site support services on the existing Niagara AX Main System and Network 8000 Microzones (referred to as TAC I/A Series System) and the GUI software, which are all vital components that make up the HVAC system at USUHS, for a base period of 12-months with four (4) 12-month options. The Uniformed Services University of the Health Sciences is the Nation's federal health sciences university and is committed to excellence in military medicine and public health during peace and war. We provide the Nation with health professionals dedicated to career service in the Department of Defense and the United States Public Health Service and with scientists who serve the common good. We serve the uniformed services and the Nation as an outstanding academic health sciences center with a worldwide perspective for education, research, service, and consultation; we are unique in relating these activities to military medicine, disaster medicine, and military medical readiness. This service will be procured in accordance with the procedures of FAR Part 12 Commercial Items and FAR Subpart 13.5 Test Program for Certain Commercial Items. Sole source determination is made in accordance with : FAR Subpart 13.501 Special documentation requirements (a) Sole source (including brand name) acquisitions. (1) Acquisitions conducted under simplified acquisition procedures are exempt from the requirements in Part 6. However, contracting officers must- (i) Conduct sole source acquisitions, as defined in 2.101, (including brand name) under this subpart only if the need to do so is justified in writing and approved at the levels specified in paragraph (a)(2) of this section; (ii) Prepare sole source (including brand name) justifications using the format at 6.303-2, modified to reflect an acquisition under the authority of the test program for commercial items (section 4202 of the Clinger-Cohen Act of 1996) or the authority of the Services Acquisition Reform Act of 2003 (41 U.S.C. 428a); (iii) Make publicly available the justifications (excluding brand name) required by 6.305(a) within 14 days after contract award or in the case of unusual and compelling urgency within 30 days after contract award, in accordance with 6.305 procedures at paragraphs (b), (d), (e), and (f); and (iv) Make publicly available brand name justifications with the solicitation, in accordance with 5.102(a)(6). According to market research, Pritchett Controls, Inc. is the only factor-authorized independent field office in the Baltimore/Washington/Eastern Shore region for Invensys Building Systems, which represents the Network 8000 System. Only the Invensys Factory-Authorized Representative is authorized to purchase Network 8000 DDC equipment. The firm provides factory-trained engineering, networking, programming, graphics generation, system installation, commissioning, and follow-up services for all of its end user product lines including the Network 8000 System. Pritchett Controls, Inc. is the only know source that can provided the requested equipment. This is not a request for quotes and a solicitation package will not be issued. Sources interested in responding to this requirement must be able to provide compelling evidence that they can provide the above-mentioned requirement as specified. A determination by the Government not to compete this proposed contractual action based upon responses received is solely within the discretion of the Government.
