- The Department of Homeland Security (DHS), Office of Procurement Operations (OPO), intends to issue a sole source contract to ESO Solutions, 9020 N. Capital of Texas Highway, Suite II-300, Austin, TX 78759 to purchase license, travel, training and ongoing support for ESO's ePCR (electronic Patient Care Record) system software, by other than full and open competition, in accordance with 41 U.S.C. 253(c)(1) as implemented by Federal Acquisition (FAR) 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. This is not a request for a proposal. A solicitation will not be issued and proposals will not be requested. The licenses are for existing ePCR software that was designed by ESO Solutions. The ePCR system software provides the single point of EMS/paramedic patient care record across all DHS. All DHS components with EMS/paramedic personnel have been issued system access and training opportunity. Continuation of this license will allow DHS to seamlessly continue to consolidate all patient records under one system. The existing software is proprietary and only ESO may grant the license and support the system. The Certification and Accreditation process took two years to complete after contract award to satisfy the new regulations implemented by the DHS Office of the Chief Information Office (OCIO) that all systems used by DHS regardless of the dollar threshold must be approved by OCIO before implementation. A reconfiguration of the ePCR system was requested by the OCIO in order to meet the C&A requirements and DHS use of the system. This resulted in a DHS instance of the ePCR system. Additionally, the contract had to be reconfigured in order to accommodate the cost incurred for these changes. The ceiling of the contract had to be increased by 10% and the period of performance was decreased by two one-year option periods. It is anticipated that a new patient care record system, if acquired under a re-compete, would undergo similar reviews and scrutiny, which would require substantial time and cost to the Government. Since ESO owns the software license, a new vendor cannot come in and start operating the system. A re-compete of the services would create a negative impact to the Government and an administrative burden; thus, it would be more costly and not in the Government's best interest not to award a sole source contract to ESO Solutions. A redacted copy of the justification prepared for this procurement will follow at a later date pursuant to the requirements of FAR 5.102(a)(6). Based on the aforementioned facts and the statutory authority at FAR 6.302-1, the Government intends to award a single non-competitive contract to ESO Solutions for these licenses after March 28, 2013.
