Description
On March 22, 2013, the Defence Finance and Accounting Service (DFAS) awarded Delviery Order HQ0423-13-F-0056 to Thundercat Tehcnology Inc. in the amount of $215,964.47 for the delivery, installation, 1 - yr license for 2 Quantum Scalar i6000 tape library upgrades for ELAN Tier Three Backup Sustainment. This task order was issued through National Aeronautics and Space Administration (NASA) Solutions for Enterprise Wide Procurements (SEWP) IV Goverment Wide Acquisition Contract (GWAC) Number NNG07DA45B. In accordance with FAR 16.505 the Brand Name Justification is attached below: Justification for an Exception to Fair Opportunity - Brand Name Tier Three File Backup Sustainment 1. Identification of the agency and contracting activity, and specific identification of the document as a "Limited Source Justification - Brand Name": This is a brand name justification acquisition for DFAS-ZTDAA, Attn: Norman Ott, 8899 E. 56th Street, Indianapolis, IN 46249-2801, under the authority of the fair opportunity process pursuant to 16.505(b)(2) of the Federal Acquisition Regulation (FAR). The Contracting Activity responsible for this action is the DFAS-Columbus, Contract Services Directorate, Building 21, 3990 E. Broad St., Columbus, OH 43213-1152. 2. Nature or description of the action: The proposed action is for tape library upgrades, for the site locations of Indianapolis and Bratenahl, which will consolidate the two Scalar 50s into the same system as the Scalar 50 systems reach end of life and support in June 2013. The upgrade of the system will reutilize the existing system cabinets and a large portion of the hardware, allowing Tier Three File Backup Sustainment support to continue past this date, thus eliminating the need to replace the entire system at a significantly higher cost. This is proposed to be a firm-fixed price (FFP) delivery order issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) IV Government Wide Acquisition Contract (GWAC). 3. Description of supplies/services required to meet the agency's needs: The DFAS Enterprise Local Area Network (ELAN) & Security Programs request the purchase of two (2) Quantum Scalar i6000 tape library upgrades for Tier Three File Backup Sustainment support. The upgrades will include up-to-date tape drives, backward compatible drives to be able to read data that has already been archived on to tape, the required licensing, installation and configuration and removal of twelve (12) existing LTO drives. The Scalar system provides enterprise backup, disaster recovery and archiving processes, of all of the critical data hosted on DFAS shared drives. 4. Identification of the exemption to fair opportunity and the supporting rationale. Fair opportunity will be provided as the Request for Quote (RFQ) will be submitted to all Contract Holders in all four (4) NASA SEWP IV GWAC contract groups. However, the requirement is limited by brand name, so per Federal Acquisition Regulation (FAR) 16.505(a)(4), a justification and approval is required using the format at FAR 16.505(b)(2)(ii)(B). "Brand-name specifications shall not be used unless the particular brand-name, product, or feature is essential to the Government's requirements and market research indicates other companies' similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency's needs." For the purposes of this requirement, the brand is limited to Quantum. Therefore, only Quantum or their authorized resellers are capable of providing the items required. The Quantum Scalar i6000 is an upgrade to our current Quantum Scalar i2000 (which was purchased in 2007) and will also combine the Scalar 50 into the same system. The Scalar 50 systems are both becoming end of life and support in June 2013. The upgrade of the system will be reutilizing the existing system cabinets and a large portion of the hardware, reducing the purchasing costs. There are no comparable products without a total redesign and complete replacement of the current system, which would cost significantly more than the cost of the upgrade. Estimated value to replace the current system in its entirety would be a 1,000% increase in acquisition cost. 5. Efforts to Obtain/Increase Competition: Market research was conducted, details of which are in the market research section of this document. Limited competition is anticipated for the required brand name item and service. Accordingly, this Justification and Approval and the Request for Quotation (RFQ) will be submitted to all four (4) NASA SEWP IV GWAC contract groups in order to fully notify all interested parties. Any quotes received will be evaluated. All SEWP IV orders are placed under existing indefinite delivery, indefinite quantity contracts, and thus are not required to be synopsized pursuant to FAR subpart 16.505(a)(1), however, notice of the delivery order award and this justification shall be made publicly available on FedBizOps.gov within 14 days after award in accordance with FAR 16.505(b)(2)(ii)(D). In order to remove or overcome barriers to competition in future acquisitions for this requirement, the agency will work with the program office to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed on other than a brand name basis. 6. Market Research: It was discovered the item is also widely available from multiple sources on NASA SEWP under Contract Groups A - D. A SEWP Prime Contract Holder cannot offer prices higher on their SEWP contract than is offered on their GSA contract. This is exclusive of the surcharge which is a minimal fee. Based on market research, utilizing the SEWP contract is most advantageous for the Government.
