Description
THIS IS A NOTICE OF INTENT, NOT A SOLICIATION FOR COMPETITIVE PROPOSALS. A SOLICITATION DOCUMENT WILL NOT BE ISSUED. The National Institutes of Health (NIH), Office of Technology Transfer (OTT), intends to negotiate on a non-competitive, sole source basis with Computer Packages, Inc. for commercial items. This contract provides payment of patent maintenance and annuity fees for the patent protection of inventions of the NIH and Food and Drug Administration (FDA) employees in the United States and foreign countries. This sole source is to enable Computer Packages, Inc. to also provide the above services on behalf of the Centers for Disease Control and Prevention (CDC). The period of performance is four (4) one-year periods. This action is under authority 41 U.S.C. 253(c)(1) as set forth in FAR 6.302-1 (Only One Responsible Source) because of the below: Only the current Contractor is uniquely qualified to perform the services required. The current Contractor, Computer Packages, Inc., has already undertaken on behalf of the Government the tracking of cases in order to maintain the patents in the United States and foreign countries and would continue to provide the service. The United States and each foreign country have different requirements, timeframes, and fees to pay. Failure to follow the appropriate steps will cause the U.S. Government to lose intellectual property rights in the United States and the foreign countries. Such a loss has a serious and direct effect on the Government. Note: This synopsis follows Sources Sought Notice HHS-NIH-OD-OLAO-SBSS-13-002 that was released on February 5, 2013.
