Description
ATEC Policy Bulletin 2-11, Organizational Conflicts of Interest (OCI) Involving Contractors in Support of ATEC Test and Evaluation (T&E) dated 19 April 2011, establishes policy to ensure that contracts awarded in support of ATEC are free of actual or potential OCI. This Policy Bulletin states that contractors may work on Army system development programs to the exclusion of participating in ATEC test and evaluation support contracts. Alternatively, they may participate in ATEC test and evaluation support contracts to the exclusion of working on Army system development programs. This is the only reliable and effective means of avoiding violations of Title 10, United States Code, Section 2399(d). Therefore, with respect to ATEC test and evaluation service support contracts, contracts will not be awarded for operational or developmental test and evaluation support to prime contractors or affiliates that are executing Army developmental programs. This is because test and evaluation support contractors may be required to evaluate the products and services of developers, their subcontractors and suppliers. The use of an advisory multi-step OCI evaluation process in accordance with FAR 15.202 is anticipated for this upcoming requirement. Phase I will be a review of any potential OCI concerning contractor affiliation with Army developmental testing. Based on this review, the respondent shall be advised (a) that they do not have an OCI or (b) that it has been determined that they have an OCI that cannot be mitigated and therefore they are considered unlikely to be a viable competitor. Phase II will be the evaluation of each offeror's full proposal. This two-step process will allow potential vendors with OCIs that cannot be mitigated to avoid the time and costs involved with preparing a full proposal. The Government anticipates that Phase I of this process, the OCI evaluation, will not take place before July 2013. Instructions regarding this process will be posted to FBO when they are available.
