Description

DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 6, Salem Medical Center, PR 658-13-2-5074-0562. 2.Nature and/or Description of the Action Being Processed: This is a request for other than full and open competition for the procurement of filter devices for the mitigation of Legionella from the vendor Pall Medical. 3.Description of Supplies/Services Required to Meet the Agency's Needs: On Friday February 22, 2013 the leadership of the Salem VAMC elected to take decisive action to address results from recent testing of the domestic water system showing increased levels of Legionella. This request is for point-of-use water filters, connection hardware and adaptors for faucets and showers in in-patient areas for the control and mitigation of Legionella. The Installation of these point-of-use filters will reduce the likelihood that patients will become infected. 4.Statutory Authority Permitting Other than Full and Open Competition: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; (X ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The vendor, Pall Medical, was recommended by Nalco, the technical services vendor assisting the Medical Center with an action plan for mitigating the Legionella, as having immediate availability of the appropriate filtration devices. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: None 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Similar filters and components were reviewed on GSA Advantage and the prices were in line or more expensive with the prices charged by Pall Medical. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: GSA Advantage was surveyed for filters with a pore size small enough to trap the bacteria, no filters were found. Due to the specialized nature of the products and the ability for Pall medical to deliver the components overnight, no further searches were conducted. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: None 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Pall Medical. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The station is working to determine if other vendors offer the specialized filters to promote competition when the installed filters require replacement. As the filter life is known, replacement filters can be competed among vendors prior to the filter change dates.
