- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 22, Network Contracting Activity, 4811 Airport Plaza Drive Long Beach CA, 90815. Transaction No.: 664-13-2-921-0245. 2.Nature and/or Description of the Action Being Processed: The VA Greater Los Angeles Healthcare System's Research and Development Department is contemplating the acquisition of laboratory services through means of other than full and open competition as authorized by FAR Part 6.302-3 "Industrial mobilization; engineering, development, or, research capability; or expert services". No other supplies or services will satisfy Government requirements. A new one (1) year firm-fixed price one-time purchase order in the amount of $40,000.00 payable to Soltesz Laboratory Services (the Lab), Department of Anatomy and Neurobiology, University of California at Irvine is contemplated. 3.Description of Supplies/Services Required to Meet the Agency's Needs: Soltesz Laboratory (the Lab) shall perform neuroanatomical characterization of 10-20 neurons, 5-10 in control and 5-10 in epileptic animal brains. Fixed animal brains shall be shipped to the Lab. The Lab will process the tissue by first sectioning the vibratome. Next, the lab will perform immunocytochemical stains for biocytin, parvalbumin, somatostatin, mGlur 1 receptor and if necessary other immunocytochemical markers such as VIP, CCK, or Reelin. Then, sections will be mounted and cover-slipped. If the staining is ideal individual neurons shall be anatomically reconstructed under Camera Lucida, a device that performs an optical superimposition of the subject being viewed upon a drawing surface which can then be traced. Finally, microscopy digital photographs shall be taken of the reconstruction drawings and incorporated into figures for further analysis and publication. These figures are the deliverables. 4.Statutory Authority Permitting Other than Full and Open Competition: (X) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The Soltesz Laboratory service shall be inclusive of skilled research scientists to perform the immunocytochemcial staining and nueroanatomical reconstructions. The Lab shall also provide all primary and secondary antibodies; histological supplies required to stain the tissue; and all other incidental supplies and services. VA Greater Los Angeles have prepared the fixed the brains for this process. Several weeks and many man hours are invested in creating the epileptic animals including but not limited to implanting EEG monitors, monitoring the animals for seizures, recording intensity and frequency of seizures to exact specification necessary for the study. When appropriate the epileptic brains are extracted from the animal and shall be supplied to the Lab. Soltesz Laboratory is the only lab that has the knowledge and expertise to perform multiple immunocytochemical stains, and identification of single hippocampal interneurons. The technique used by the lab is not exclusive to the lab as it is commercially available; however its application in this case is specific to this particular research. This lab is the international authority in the field of hippocampal interneuron chemical anatomy. The outcome of this Government research relies exclusively upon the unique services of this lab to maintain the board approved research methodology and must be consistent with the research itself. Soltesz Laboratory has pioneered ground breaking research as it pertains to seizures after a head injury; epilepsy; and fever-induced seizures in children. 5.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Market research was conducted as and there are a range of Universities that are experimenting with this field of neurobiology with various focuses. However, are not specifically focusing on seizures and epilepsy. Soltesz Laboratory has published works and result sets in the Journal of Neurocytology; articles in Wiley Press; Science Direct; and is world renowned for its work in the advancement of this field. No other labs are performing this very important work. 6.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The cost or price of $40,000.00 is considered fair and reasonable. This determination was based on market research as to the necessary supplies and the labor cost associated with this service. This service is a commercial item therefore cost and pricing data is not available. However, based on internet list pricing for like cost elements consider the following should cost estimate: Antibodies (Protein/Peptide): 40 TGF Beta 1 Protein.005ug @ $509.00 (ug = nanogram)= $20,360.00 Stains: 1 case @ $67.00= $67.00 Supplies/Overhead: $1000.00 Labor: Postdoctoral Research Associate: $24.04 p/h @ 1040 hrs (part-time) = $25,001.60 Estimated Total: $46,394.60 7.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was conducted as and there are a range of Universities that are experimenting with this field of neurobiology with various focuses. None however are specifically focusing on seizures and epilepsy. Soltesz Laboratory has published works and result sets in the Journal of Neurocytology; articles in Wiley Press; Science Direct; and is world renowned for its work in the advancement of this field. No other labs are performing this very important work. 8.Any Other Facts Supporting the Use of Other than Full and Open Competition: N/A 9.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: See Section VI above 10.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Research and Development is often pre-approved by various boards at the station or national level. These boards designated the when, why, and how Government funded research studies are to be conducted. R&D rarely allowed to deviate from what the board has approved.
