- This contract action was accomplished using other than competitive procedures because the procurement is awarded to a sole source under the Test Program for Certain Commercial Items (FAR 13.5). See posted J&A for further information. MEMORANDUM FOR RECORD FOR OTHER THEN FULL AND OPEN COMPETITION PRIORITY 03 1. Contracting Agency: Southern Regional Contracting Office, Fort Sam Houston, TX 78234 2. Description of Action: Urgent procurement of SpineArt posterior lumbar interbody fusion (PLIF) L4/5 surgical implants. This action has an unusual and compelling urgency that could be detrimental to the medical health care mission or could result in loss of life. 3. Description of Products/Services: This requirement is for surgical implants needed for urgent care of a truama patient, Brooke Army Medical Hospital (BAMC), Fort Sam Houston, TX. 4. Authority Cited: 10 U.S.C. 2304(c) (2) is implemented by FAR 6.302-2(a) (2) Unusual and compelling urgency. The agency's need is of such an unusual and compelling urgent nature that without the SpineArt orthopedics surgical implants the medical healthcare mission will be compromised unless the agency is permitted to limit the number of sources from which it solicits quotes. -Pursuant to FAR Part 5.202(a) (s), Exceptions, the unusual and compelling requirement will not be advertised. -Pursuant to FAR Part 13.106(c) (1), Soliciting competition, price and availability will be obtained telephonically. 5. Reason for Cited Authority: The above statutory authority is cited because this is a true, urgent request that has been verified by Joann Espitia on 05 March, 2013. The surgical implants are needed for a trauma patient for 10 March, 2013 and without it would compromise medical care and life threating patient. 6.
