Description

DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 2, Bath VA Medical Center located at 76 Veterans Avenue, Bath, NY 14810, has submitted Procurement Request 528-13-2-6307-0264. 2.Nature and/or Description of the Action Being Processed: This is a request for Other Than Full and Open Competition for the procurement of STAT Lab Specimen Testing services from Ira Davenport Memorial Hospital, located at 7571 New York 54, Bath, NY 14810. 3.Description of Supplies/Services Required to Meet the Agency's Needs: The Bath VA Medical Center, in order to continue to provide emergency and acute care services, requires a service contract with a community partner hospital to provide stat laboratory specimen testing in the event of analyzer equipment failure or critical staffing shortages at the Bath VA Medical Center. 4.Statutory Authority Permitting Other than Full and Open Competition: 41 USC §253(c)(1), as implemented by FAR 6.302-1. (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The nature of this acquisition is such that the rural nature of the Bath VA Medical Center makes it geographically impossible to contract with another community hospital in the area to provide this service within the timeframes that we require. STAT Lab Specimen Testing is critical to eligible Veteran beneficiary patient care. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: In this situation, solicitation from other sources is impractical as there are no other available services on a 24 hour, 365 day per year basis in the immediate geographical area. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated price to the Government for STAT Lab Specimen Testing covering the period March 1, 2013 through February 28, 2014 is $20,000.00. Price is determined reasonable by the contracting officer based on historical pricing paid by Bath VA to Ira Davenport Memorial Hospital in addition to an established price schedule reflecting Medicare rates plus 10 percent. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research performed is included herewith. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: None 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: In this case, barriers to competition cannot be overcome for the reasons described in 5 and 6 above. 12.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief. _____________________________ ________________________ Name: Michael KnightDate Title: Administrative Assistant to the Chief of Staff Facility: Bath VA Medical Center 13.
