Description
This document is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation and notice that proposals are being requested. A written solicitation will not be issued The proposed contract action is for supplies or services for which the Government award using Full and Open Competition. Interested persons may submit offers, and all eligible offers received prior to the date/time specified will be considered by the Government. The NAICS code is 339112 and the size standard is 500 employees. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-66. Only emailed requests received directly from the requester are acceptable. Technical Approach, 2. Past Performance, 3. Subcontracting Plan, 4. Official Representations and Certifications, and 5. Price/Cost. (2)Offers must be sent to daniel.czech@va.gov by noon PT on the date specified in FBO. Only electronic offers will be accepted. (3)The VA may reject incomplete responses from offerors. (4)Hands-on Evaluation If selected to be in the downselect group mentioned below, the offeror shall, at a time/date of the Government's choosing, install the offered product into a surgical room at the SFVAMC for a period of one week for hands-on evaluation purposes. (5)Technical Approach Offerors shall provide documentation that proves their offered product meets the specifications required in paragraph four of the attached statement of work. (i)Offers must- (A)Clearly identify the item by- (1)Brand name, if any; and (2)Make or model number; (B)Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer. (C)Clearly describe any modification the offeror plans to make in a product to make it conform to the solicitations requirements. The offeror must mark any descriptive material to clearly show the modification; and (D)Clearly describe how the offeror will meet the installation specifications/specific tasks in paragraph five of the Statement of Work. (E)A table of contents of those specifications in paragraph four of the attached statement of work with a page reference of the offeror's proposal where the offeror meets the required specification. (6)Past Performance The offeror shall provide up to three (3) recent (within the last three years) contracts which are similar in scope, magnitude and complexity to the subject requirement. The offer shall include: (i)Government Agency/Company which awarded contract to offeror (ii)Contract Number (iii)Description of Contract Scope (iv)Total Dollar Value (v)Performance Period (vi)Place of Performance (vii)Contracting Officer/Procurement Official (A)Name (B)Email (C)Phone Number (D)Address (7)Subcontracting Plan The offeror shall provide a subcontracting plan in accordance with FAR 52.219-9 Alt. II Small Business Subcontracting Plan. The subcontracting plan shall clearly be delineated from the other volumes. Small business concerns must clearly identify their size status that exempts them from the subcontracting plan requirement. The VA has established the following subcontracting goals: (i)Small Business17.5% (ii)Veteran-Owned Small Business (VOSB)5.0% (iii)Service-Disabled Veteran-Owned Small Business (SDVOSB)3.0% (iv)Small Disadvantaged Businesses (including Section 8(a))5.0% (v)Women-Owned Small Businesses (WOSB)5.0% (vi)Historically Underutilized Business Zone (HUBZone) Small Business3.0% (8)Official Representations and Certifications Offerors shall provide a completed FAR 52.212-3 Offeror Representations and Certifications - Commercial Items. Offerors must either (i) complete and return this provision or (ii) complete official representations and certifications online at https://www.sam.gov and complete and return the appropriate parts of FAR 52.212-3. Please note: Official Representations and Certifications is not part of an evaluation factor; however, it will be used to determine an offeror's eligibility to receive award. (9)Price/Cost (i)The offeror shall provide a price schedule for this volume. Offers must be valid for 90 days from the date the solicitation closes. (ii)In accordance with FAR 15.403-3, the offeror shall provide data other than certified cost or pricing data, at the request of the Contracting Officer. FAR 52.212-2 - Evaluation -- Commercial Items (Jan 1999) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers in descending order of importance: "Hands-on Evaluation as described below. Only downselected offerors will be evaluated on this factor. This factor will be rated on a five-level Likert scale. Offerors must be rated adequate or better to be considered for Award (including all subfactors). "Technical Approach shall be evaluated on a pass/fail basis based on the specifications/specific tasks listed in the paragraphs four and five of the attached statement of work. At any time, if a product is found to not meet the specifications/specific tasks, including during the hands-on evaluation, the VA will no longer consider that product for award. "Past Performance shall be evaluated on a pass/fail basis. Any offeror with no past performance shall be rated as neutral. "Subcontracting Plan shall be evaluated as described below. "Price Non-price factors, when combined, are significantly more important than price. (b) An offeror's past performance will be evaluated as to its relevance and similarity to work under this solicitation. The Government may contact the offeror's references for information and may review performance ratings on file for prior Government projects the offeror may have performed. Past performance information obtained from sources other than those identified by the offeror may be used. All relevant facts and circumstances gathered from information from the offeror's listed references and other sources of information available to the Government (e.g., National Institutes of Health [NIH] Contractor Performance System [CPS] and Past Performance Information Retrieval System [PPIRS]) will be used to evaluate the offeror's overall past performance and quality of performance. If an offeror has not had a chance to comment on negative past performance evaluations obtained VA for purposes of evaluating offers under this solicitation, the offeror may be given a chance during "exchanges" (clarifications, communications, or discussions) after receipt of proposals (FAR 15.306). If discussions are required, and past performance issues remain, these issues will be addressed during discussions. (c) The VA shall evaluate Subcontracting Plan with respect to the requirements of the clause at FAR 52.219-9 Alternate II and how closely it meets the stated subcontracting Goals on a five-tiered scale: Excellent, Good, Adequate, Poor, and Unacceptable. Small business concerns may submit subcontracting plans; however, they are not required to do so. Small business concerns will automatically receive an "Adequate" should they choose to not submit a subcontracting plan. Small business concerns submitting a subcontracting plan may receive a higher rating, but will receive no less than an "Adequate" rating. VOSBs and SDVOSBs are treated the same as small business concerns with following changes: VOSBs will automatically receive a "Good" rating (but may receive a higher rating if they submit a subcontracting plan). SDVOSBs will automatically receive an "Excellent" rating under this factor. (d) The Government, including the Technical Evaluation Board (TEB), will evaluate offers after the due date. The Government may then determine a downselect group comprised of those offerors most likely to receive award based on technical acceptability, past performance, subcontracting plan, and price. The Government may determine that the number of offerors most likely to receive award in the downselect group exceeds the number at which efficient competition can be conducted. Consequently, the Government may further limit the number of offerors in the Downselect Group to the greatest number that will permit an efficient competition among those offerors most likely to receive award. (e) Those vendors in the downselect group shall provide and install their offered product in a SFVAMC surgical room for a period of one week for hands-on demonstration purposes. The non-voting Advisory TEB members shall complete a closed-ended questionnaire regarding the offered product's ability to meet their needs while performing surgery, using a Likert scale. These completed questionnaires will advise the voting TEB members with regards to the evaluation of the proposed equipment. The following subfactors shall be evaluated in the hands-on portion of the demonstration. The sub-factors are of equal importance. (1)Color Rendering: (How do the objects in the surgical field appear?) (2)Focal Spot: (How well is the surgical field properly illuminated?) (3)Light Arm Movement / Adjustability: (How are human factor elements incorporated with respect to movement, ease of use, and light positioning?) (4)Light Quality: (How well is the surgical field illuminated with the appropriate intensity, adjustability, and effective manner required?) (5)Shadow Resolution: (How well does the light have adequate shadow management control?) (6)In-Light Surgical Camera: (How well is the picture quality, focused, crisp, and clear?) (f) The Government intends to make award without discussions. However, the Government reserves the right to designate a competitive range-based on evaluation of Technical Approach, Past Performance, Subcontracting Plan, and Price; if hands-on demonstration has already occurred, this factor shall also be utilized in designating a competitive range-and holding discussions, if necessary. The decision to designate a competitive range and hold discussions is solely within the Government's discretion. The Government further reserves the right to limit the competitive range in accordance with FAR 15.306(c)(2). (g) The Government shall make award based on the tradeoff between the non-price factors and price. To be considered for award, and offeror's response must be rated a pass on Technical Approach and Past Performance, and Hands-On Evaluation and Subcontracting Plan must be rated adequate or better (including all sub-factors). (h) The Government will evaluate the offers on the basis of information furnished by the offeror or identified in the offer and reasonable available to the Contracting Officer. The Government is not responsible for locating or obtaining any information not identified in the offer. (i) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (j) See the attached Source Selection Plan. Where there is a conflict in evaluation procedures between the solicitation and the source selection plan, the source selection plan shall take precedence.
