- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1. Identification of the Agency and the Contracting Activity: United States Department of Agriculture, Forest Service Eastern Region 626 E. Wisconsin Ave. Milwaukee, WI 53202-4616 2. Nature and/or description of the action being approved: Justification and approval for other than full and open competition for the acquisition of the replacement contract for Camp Nesbit Improvements. The original contract (AG-4419-C-10-0546) was placed into default on February 23, 2012. The Surety was offered to assume the contractor responsibilities to ensure the work was completed. The Surety opted to pay the penal sum of the bond instead. 3. A description of supplies/services required to meet the agency's needs (including the estimated value): In accordance with the statement of work the contractor shall provide construction services to perform improvements to the Environmental Education Camp Nesbit, Ottawa National Forest. Work to include 1) Reconstruction of existing accessible elements /components (i. e. ramps, entrances / exits, doorways, doors, routes, etc. ) of A) Kitchen / Mess Ha11, B)Recreation Ha11, & C) three sleeping quarters building units 2) Construction of accessible elements,/components (i.e. ramps, entrances / exits, doorways, doors, routes, etc.) for A) Nine remaining non-accessible cleaning building units, B) three bathroom/shower buildings, & C) the Director's, / Caretaker's sleeping quarters building unit 3) Demolition (i.e. "gutting") and renovation,/ reconstruction /rehabilitation of the interiors of three bathroom / shower buildings to meet current ABA standards; 4) Refinishing or replacement of flooring in the Recreation Hal1 building and in the Kitchen / Mess Hall building 5) Repair exposed stone chimneys on the three bathroom / shower buildings & on the Director's, /Caretaker's sleeping quarters building unit; 6) Replace plumbing fixtures in Kitchen / Mess Hall building restroom; 7) In the Kitchen areas of the Kitchen / Mess Hall building, add floor drains & connect to existing sanitary pipeline below floor; and 8) Replace ceiling and wall finishes in the kitchen areas. 4. Statutory authority permitting other than full and open competition: FAR 6.302-2 - Unusual and Compelling Urgency 5. Proposed Contractor's Unique Qualifications or the nature of the acquisition that requires the use of the authority cited: This requirement is considered to be of compelling urgency since the original contract work was to have been accomplished 2 years ago and unfinished work is causing potential safety hazards. The current conditions of the Environmental Camp are considered to be unsafe for occupation and sanitary conditions require the use of port-a-potties for personal sanitation and their continued use places children at risk. 6. Efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies: The original requirement was solicited full and open, after exclusion of exclusion of sources. The awardee is the offeror who provided the second lowest offer under the original requirement. 7. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable: Negotiations were conducted, and the prices offered were compared with the original offered pricing. Pricing was considered to the fair and reasonable based on the comparison. 8. Market survey conducted and the results or a statement of the reason market research was not conducted: A market survey was performed as a part of the original solicitation requirements. Due to the nature of the requirement and the fact that the Surety chose to provide the USDA Forest Service with the penal sum of the bond in lieu of providing work performance no additional market survey was conducted. 9. Other facts supporting the use of other than full and open competition, such as: The original requirement was awarded on 06/30/2010 (Contract AG-4419-C-10-0546). This contract was terminated for default on 02/23/2012 for (1) failure to provide certified payroll documents; (2) failure to provide work schedule; (3) failure to provide stored materials that the Government had paid for; and not completing the work timely. The Surety chose to provide the penal sum of the bond in lieu of providing work performance. As a part of the default action, the Surety was offered take over agreement, but chose to provide the penal sum of the bond instead. A letter was forwarded to the surety of the Performance Bond (K08284064) ACE Surety - Claims Department on June 22, 2011 requesting a Surety Takeover Agreement for this project. The condition of the work performed by the original contractor was such that it was determined to be in the Government's best interest to negotiate new work requirements. There was insufficient time available to totally rework the contract requirement documents. Negotiations were necessary to obtain a clear understanding of the adjustments to the original plans and specifications. 10. Other sources expressing an interest, if any: NONE 11. Actions to remove or overcome any barriers to competition: N/A 12. Certification: I certify that this justification is accurate and complete to the best of my knowledge and belief. Any supporting data that is the responsibility of technical or requirements personnel (e.g., verifying the Government's minimum needs or schedule requirements or other rationale for other than full and open competition) and which form a basis for the justification have been certified as complete and accurate by the technical or requirements personnel. /S/ MARK CORSE Contracting Officer
