- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, VISN 6, Salem Medical Center, submits a justification of other than full and open competition for purchase request 658-13-3-5071-0458. 2.Nature and/or Description of the Action Being Processed: The Salem VAMC experienced a natural gas leak, natural gas being the primary fuel source for the Medical Center's boilers. Salem VAMC's boilers produce heat for the hospital, hot water which is used for patients, cooking, and sterilization. The secondary fuel source for the boilers is fuel oil. Due to the emergent situation created by the gas line leak, the medical center switched to the emergency fuel oil stored on campus but required replenishment as the fuel oil would be used quickly. 3.Description of Supplies/Services Required to Meet the Agency's Needs: The station ordered XXXX gallons of fuel oil for a total cost of $97,280.00. 4.Statutory Authority Permitting Other than Full and Open Competition: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; (X) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Roanoke Oil Distributer was able to provide the volume of oil to the medical center after order, avoiding the shut down of the Building 13 boilers. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: The medical center has determined the scope of the gas leak and will be able to determine if more fuel oil is required prior to the reserves running critically low. If more oil is needed, area oil providers will be contacted to provide quotes. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable. Wholesale heating oil on the NYMEX was $2.9535, and the average heating oil cost nationwide on 3/18/2013 was $4.009. The price per gallon paid to Roanoke Oil Distributers was XXXX, a price the contracting officer found to be fair and reasonable. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: No market research was conducted due to the emergent nature of the situation. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: None. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: See Section VI above. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Oil levels will be monitored and if additional deliveries are required the station will submit the purchase request 3-5 days before the order must be placed so the contracting officer may solicit quotes.
