Description

JUSTIFICATION AND APPROVAL FOR A LIMITED SOURCE AWARD UNDER A FEDERAL SUPPLY SCHEDULE 1. Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 260 Industrial Way West Eatontown, New Jersey 07724 2. Description of Action: The proposed action is for a 12 month firm-fixed price (FFP) contract for Statistical Analysis System (SAS) maintenance renewal support, with Executive Information Systems (EIS). This effort is proposed to be awarded on a sole source basis under the General Services Administration (GSA) Federal Supply Schedule (FSS) Contract Number GS-35F-0170K to EIS, 6901 Rockledge Drive Ste 600, Bethesda MD, 20817-7836. 3. Description of the Supplies or Services: The proposed action is to provide SAS maintenance renewal for SAS Version 9.3. The maintenance renewal will enable the Office of Information and Technology (OIT) to continue to utilize the SAS computational and analytical toolset to analyze statistics on VA programs to inform and enable improved outcomes for Veterans through better policies and improved efficiency and effectiveness of VA operations. 4. Statutory Authority: Federal Acquisition Regulation (FAR) Part 8.405-6(a)(1)(i)(B), Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized. 5. Rationale Supporting Use of Authority Cited Above: The proposed source for this action is EIS. EIS is the exclusive authorized reseller for version eight and later of the SAS maintenance renewal as detailed in the market research section. SAS Analytics provides an integrated environment for predictive and descriptive modeling, data mining, text analytics, forecasting, optimization, simulation, and experimental design. SAS provides a range of techniques and processes for the collection, classification, analysis and interpretation of data to reveal patterns, anomalies, key variables and relationships, leading to new insights and better answers faster. Only SAS offers an integrated suite of analytics software that provides the interoperability and compatibility with the current OIT environment. SAS software is the only complete functional statistical program that can be utilized by OIT because of compatibility with existing data throughout VA and affiliated institutions. This request is to provide annual software maintenance renewal for SAS products Version 9.3 currently installed on user work stations. Failure to renew the software maintenance will result in an inability to receive software updates including security patches and updates. Without this analytical software supporting OIT's computing environment, OIT will not be able to provide VA with the latest analytical support for patient safety and healthcare outcomes initiatives, which are becoming increasingly large and complex. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. This effort did not yield any additional sources that can meet the Government's requirements. There is no competition anticipated for this acquisition. 7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed. Additionally, this Justification and Approval and the Request For Quotation will be posted to e-Buy. Any proposals that are received will be evaluated. In accordance with FAR 5.202(a)(11), this effort is exempt from synopsizing since the proposed contract action is an order placed under an existing contract. 8. Market Research: Market Research was conducted on February 15, 2013 utilizing the National Aeronautics and Space Administration (NASA) Solutions for Enterprise Wide Procurement (SEWP) Government Wide Acquisition Contract (GWAC) Manufacturer Lookup tool and the GSA Advantage Product tool. VA identified seven authorized resellers for SAS products on the NASA SEWP GWAC. However, further market research indicated that none of the seven authorized resellers under NASA SEWP are capable of providing SAS maintenance renewal support for SAS Version 9.3. On February 21, 2013 it was discovered EIS is the exclusive reseller of SAS products and services of Version eight or later to the US Government. Furthermore, on February 28, 2013 a Request for Information (RFI) was posted on the Federal Business Opportunity (FBO) Page to verify if there are any authorized resellers who can provide the maintenance renewal for SAS Version 9.3. On March 1, 2013, the RFI closed; two companies responded to the RFI, EIS was the only company capable of providing the SAS maintenance renewal for SAS Version 9.3. 9. Other Facts: None.
