- This notice provides details from the Limited Source Justification approved in support of a 90-day Task Order DE-DT0005365 with Delta Research Associates Inc. I. IDENTIFICATION OF AGENCY/CONTRACTING ACTIVITY The Department of Energy?s (DOE), Office of Intelligence and Counterintelligence (IN) plans to issue task order, DE-DT0005365, to Delta Research Associates, Inc. (DRA) by means of this Limited Sources Justification via the Federal Supply Schedule (FSS), in accordance with the Federal Acquisition Regulation (FAR) 8.405-6. The Office of Headquarters Procurement Services (MA-64) will execute this action. II. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED This action is to provide a transition period from the task order currently being performed by DRA. It is anticipated that the transition period under this task order will be for three months (from April 13, 2013 to July 12, 2013). A follow-on competitive FSS procurement is in progress and award is anticipated in the 4th quarter of Government fiscal year 2013. This task order will allow for the transition of work to the newly awarded competitive task order once it is in place to prevent an interruption to the level of support that IN requires to perform DOE mission critical services. An interruption to the services currently being provided would compromise the protection of the United States of America against threats posed by nuclear proliferation and terrorism. As such, DRA currently provides the DOE mission critical support services assisting with the creation of and accessibility to an integrated system of information from all sources concerning worldwide nuclear material holdings and their security status. The purpose of this justification is to issue a task order for the period of performance of April 13, 2013 to July 12, 2013 as a Limited Sources Justification pursuant to FAR 8.405-6(a)(1) to provide continued support and transition services in order to avoid a break in service for mission critical support during the transition to a new competitive task order. III. DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY?S NEEDS, INCLUDING ESTIMATED VALUE This requirement is to ensure that there is no break in service or potential mission impact. The services being acquired during this extension period are consistent with the work DRA currently is performing under the current task order. The scope of this effort supports the continued success of IN?s efforts to provide timely and actionable strategic intelligence analysis; ensure intelligence security throughout the DOE complex; and cultivate and encourage the intelligence capabilities and contributions of DOE's technical, analytical, and research expertise is applied to the nation's most difficult technical intelligence challenges. The task order support includes the following: technical and analytical services in the areas of counterintelligence, foreign risk management, science and technology, collections and proliferation. It is estimated that the negotiated ceiling amount for the task order will be $973,908. IV. RATIONAL FOR LIMITED SOURCES AND UNIQUE QUALIFICATIONS OF THE PROPOSED CONTRACTOR FAR 8.405-6 requires an ordering activity to justify its actions when restricting competition of schedule contractors under FAR 8.405-2. The specific circumstance justifying the restriction for this acquisition is FAR 8.405-6(a)(1)(i)(B), which allows for limiting sources when only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized. An interruption to services provided under this task order would create substantial risk to IN?s mission. DRA has provided highly specialized critical support to IN over the past five years and continued support and transition services to the next long-term support services task order is necessary in order to not compromise the United States against threats posed by nuclear proliferation, terrorism and cyber operations. This task order allows the Government to maintain the current level of highly specialized expertise and support without a break in service and will ensure the proper transition takes place to the next support service contractor. No other vendor is in a position to provide DOE continued support without causing a detrimental effect to the level of support required for IN?s mission. The nature of this acquisition is such that the current task order will expire on April 12, 2013 and the award of a new competitive task order is not anticipated prior to this expiration date. This extension is necessary to provide the required continuity of services for achievement of IN?s mission objectives without interruption while DOE continues its efforts to award a new task order. It is recommended that the base period of the task order be from April 13, 2013 to July 12, 2013. V. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ACTION REPRESENTS BEST VALUE TO THE GOVERNMENT IN ACCORDANCE WITH FAR 8.404(d). DRA is in a unique position to continue support of IN without an interruption in service. The initial task order requirement was issued competitively in April 2007. DRA?s performance has been acceptable in meeting all of their performance requirements. Furthermore, DRA has maintained discounts on their GSA Schedule labor rates throughout the period of performance. Based on DRA?s acceptable performance under their current task order, the providing of discounted rates, the importance of continuity of services, and the measurable contribution to the IN mission goals that the contractor has achieved; this short-term task order is in the best interest of the Government. The use of discounted rates previously negotiated and determined fair and reasonable by GSA ensures that award of this task order is the best value to the Government. VI. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS OF THE SURVEY (OR STATEMENT OF REASONS NO SURVEY WAS CONDUCTED) Market research was not conducted for this requirement because this requirement is to ensure continuity of services and transition support. A competitive acquisition is currently in progress to provide long-term support for IN. VII. OTHER FACTS SUPPORTING USE OF OTHER THAN FULL AND OPEN COMPETITION No other facts supporting use of limited sources have been identified beyond those documented in this Limited Sources Justification. VIII. ACTION THE AGENCY MAY TAKE TO REMOVE OR OVERCOME BARRIERS WHICH LED TO RESTRICTED CONSIDERATION BEFORE ANY SUBSEQUENT ACTIONS. There will not be any barriers that will lead to restricted competition as the successor to this task order was based on a competitive process. The circumstances resulting in the need for restricted competition for this 3 month period are temporary and should not be a factor in future competitions.
