52.212-3 Offeror Representations and Certifications—Commercial Items. SECTION B - CONTINUATION BLOCK B.1 PRICE SCHEDULE - AUDIOLOGY SERVICES FOR WIND RIVER SERVICE UNIT: This procurement is conducted pursuant to the authority of Federal Acquisition Regulation (FAR) Part 13, Simplified Acquisition Procedures; FAR 37.6, Performance-Based Acquisition and FAR 37.4, Non-Personal Service Contract(10 U.S.C. 2304 and 41 U.S.C. 253. The Billings Area Indian Health Service (IHS) intends to award a fixed-price purchase order in response to Request for Quotation (RFQ) 10-13-021-JH to acquire an Audiologist for the Indian Health Service, Wind River Service Unit, PHS Indian Health Center, Fort Washakie, Wyoming and the Arapahoe Health Center, Arapaho, Wyoming. The Solicitation clauses and provisions are those in effect through Federal Acquisition Circular 2005-66. The associated North American Industry Classification System code is 621340 and the small business size standard is $7.0 million. Potential offerors are asked to submit an offer for both locations by including a rate for the base year and each option year. The proposed daily rates must be inclusive of transportation, food, lodging, et cetera. Washakie Health Center @ $ per day = $____________ GRAND TOTAL...................................... $______________ B.2 PERIOD OF PERFORMANCE The performance of this contract shall be from Award Date, through September 30, 2013, with two (2) 12-month options: If the Government exercises the options pursuant to Federal Acquisition Regulation (FAR) 52.217-9, Option to Extend the Term of the Contract (MAR 2000), the period of performance shall be extended in accordance with the following schedule: Year Option Period Option Year One (1) October 1, 2013, through September 30, 2014 Option Year Two (2) October 1, 2014, through September 30, 2015 B.3 INTRODUCTION AND PURPOSE OF THE CONTRACT The services are to be provided at the Wind River Service Unit, PHS Indian Health Center, Fort Washakie Health Center, Fort Washakie Wyoming and Arapahoe Health Center, Arapahoe Wyoming. The purpose of the contract is to acquire direct diagnostic and rehabilitative audiologic services. The procurement is a nonpersonal health care service contract, as defined in FAR 37.101, under which the Contractor is an independent contractor. The Government may evaluate the quality of professional and administrative services provided but retains no control over the medical and professional aspects of services rendered (e.g., professional judgments, diagnosis for specific medical treatment). The Contractor shall indemnify the Government for any liability producing acts or omissions by the Contractor, its employees and agents occurring during contract performance. The Contractor shall maintain medical liability insurance, which is not less than the amount normally prevailing within the local community for the medical specialty concerned. The Contractor is required to ensure that its subcontracts for provisions of health care services contain the requirements of the clause at 52.237-7, including the maintenance of medical liability insurance. B.4 PERFORMANCE WORK STATEMENT FOR THE WIND RIVER SERVICE UNIT (1) The Audiologist will provide a total of 14 days of direct diagnostic and rehabilitative audiologic services to the Wind River Service Unit, 14 days at the Arapahoe Health Center and 18 days at the Ft. Washakie Health Center which will include travel and clinics coordinated with the Service Unit. (2) The Audiologist will receive referrals and serve as consultant to the Wind River Head Start and Early Head Start Programs, Early Intervention Program, St. Stephens Indian School, and local public schools, as needed. (3) The Audiologist is responsible for the selection, provision, and interpretation of comprehensive audiologic evaluations to include but not limited to the following: Air and bone conduction testing; Speech and Reception and Discrimination testing; Immittance testing; Otocacousic Emissions testing; Soundfield testing; Play Audiometry; and other Site-of-Lesion tests. (4) The Audiologist will properly record audiology services in the patients' medical record or electronic health record or EHR to assess audiology needs and provide the required audiology care. (5) The Audiologist will prepare the patient for otologic examinations, audiologic testing and treatment. (6) The Audiologist will maintain inventory and calibration of audiologic equipment. (7) The Audiologist will provide audiologic services for specialty clinics such as Ear-Nose-Throat (ENT) and provide all necessary pre- and post-operative evaluations on all otologic surgical patients. (8) The Audiologist will act as an intermediary between the patient, Service Unit personnel, Tribal personnel, State and Federal agencies. (9) The Audiologist will maintain a current state license, as required, by continuing education activities (CEUs). (10) The Audiologist will participate and provide the Wind River Service Unit an invoice after delivery of service every month. (11) The Audiologist will participate and provide quarterly chart reviews as randomly selected by the Service Unit to evaluate audiology services. The evaluation should be given to the Project Officer by the end of each quarterly month. See attached schedule for chart evaluations. B.5 GOVERNMENT FURNISHED PROPERTY The following will be provided by the Government: Specialized audiology equipment and supplies needed to perform and deliver audiology and hearing aid services at the Service Unit. The Department will provide orientation to the Contractor as to their specific duties and responsibilities. The Department is responsible for getting the Contractor access and clearances to all pertinent computer services necessary to carry out his/her duties. B.6 COMPUTER SECURITY Pursuant to the Federal Information Security Management Act of 2002 (FISMA), the contractor will be required to complete a course in Computer Security Awareness Training (CSAT). This training must be completed annually by all employees including contractors, volunteers, students, and summer externs. The Contractor will be required to comply with the Federal Information Processing Standards Publication (FIPS PUB) Number 201, "Personal Identity Verification of Federal Employees and Contractors," and the associated Office of Management and Budget (OMB) implementation guidance for personal identity verification for all affected contractor and subcontractor personnel. Access/clearance to all pertinent computer system, including completing a Business Partner Interconnection Security Agreement (BPISA), Should be coordinated with the OIM. B.7 PERFORMANCE-BASED SERVICE DELIVERY SUMMARY The contract Audiologist's performance will be measured based on the following Performance Requirements. The Performance Requirements will be measured against Government Performance Standards and monitored in accordance with the following Methods of Government Surveillance to determine compliance. A 5% deduction will be assigned to each Performance Requirement. Deductions shall be assessed against individual invoices when services are not performed or do not meet contract requirements. Peer Reviews - 10 randomly selected medical records PCC's sent to the project officer or his/her designee by the 10th of each quarter and reviewed by the 20th. 5% deduction from quarterly invoices if 10 PCC's are not sent for review and has 25% or more inadequate marks. Customer Service Section B Reasonable, cooperative, and a commitment to customer satisfaction. Validated call-in patient complaints. 5% deduction of 5 or more patient complaints. Adherence to Contract Schedules Subsection B.4 Scheduling of Audiology and Hearing Aid Clinic. Misses 3 scheduled clinics per contract year. 5% deducted from the following months invoice. B.8 CONTRACTING OFFICER AUTHORITY Authority to negotiate changes in terms, conditions, or amounts cited in this contract is reserved to the Contracting Officer. B.9 CONTRACTING OFFICER REPRESENTITIVE The project officer for this contract will be JoLynn Davis, Director of Nurses, Fort Washakie, Wyoming. The project officer shall be responsible for: (1) Monitoring the Contractors technical progress, including surveillance and assessment of performance and recommending technical changes; (2) Interpreting the Statement of Work; (3) Technical evaluation as required; (4) Technical inspections and acceptance; and (5) Assisting the Contractor in the resolution of technical problems encountered during performance of this contract. The Audiologist will provide professional leadership and program direction in administrative practices related to audiology services to insure fulfillment of the Wind River Service Unit goals and objectives by setting and maintaining standards for the clinical practice of Audiology. In addition, provides program consultation to assist the Service Unit; and other Federal, State and local agencies. 2. The Audiologist has the responsibility to act as an intermediary between patients, Service Unit personnel, Tribal personnel, and Wind River Service Unit Office personnel, as well as the expert resource for referring patients to other facilities, and local, State and Federal agencies. 3. The Audiologist has the responsibility to design, initiate and evaluate audiological services at the request of the Service Units or Health Care Supervisor. This may include quality assurance peer review of medical records/EHR, establishing criteria for services, coordination of services, developing policies and standards, assessing the needs, program trends and the effective use of services for the highest achievable quality of services. 4. The Audiologists has the responsibility for maintaining an inventory of accessories for a fully functioning and dispensing hearing aid practice. Maintain a calibration schedule for all audiologic equipment belonging to the Service Unit. The Audiologist will review Service Unit audiologic equipment regularly for replacement and updating. Submit request of supplies or recommendation of equipment to the Service Unit with estimate of cost as needed. 5. The Audiologists will participate in professional societies to keep abreast of new developments in audiology, review current literature, and view demonstrations of new equipment and procedures. Be able to integrate policies and procedures from ASHA, AAA and other accreditation organizations such as Joint Commission with the Wind River Service Unit mission, vision and goal by strategic planning, budgeting, and conducting meetings with Communication Disorder Program to keep staff abreast of work requirements, methods and procedures as needed. B.12 KNOWLEDGE REQUIRED BY POSITION: 1. Knowledge of established professional audiologic concepts, principles, and practices; and otologic diseases necessary to assess the extent of a hearing disorder and its effect upon communication, health, vocation, and socialization for appropriate treatment or referral. 2. Knowledge of Communication Disorders Program policies and practices as well as cultural, social and economic characteristics of the Native population relative to adapting, redesigning or modifying audiology principles to the varied population. 3. Knowledge of the relative value for audiologic evaluations and the principles and practices that govern the evaluations to serve as technical authority, expert advice and direction about the audiological aspects of the health care delivery system. 4. Knowledge of the current VA hearing aids on contract, standards and advances in hearing aid fittings, earmold modifications, frequency response, and other electro-acoustics modifications. Knowledge of aural rehabilitation procedures to provide appropriate amplification and counseling to the hearing impaired. Also familiar with ANSI standards of calibration. 5. Knowledge of Privacy Act and HIPAA regulations of patient confidentiality. 6. Skills in oral and written communication to maintain effective working relationships at the Service Unit, Wind River Service Unit Office, Tribal personnel, vendors, contractors, and other Federal, State and local agencies. 7. Must possess and maintain a current State license and ASHA certification. (e) The Government reserves the right to make award solely on the facsimile proposal. [The offeror shall enter the name or names of the HUBZone small business concern or concerns that are participating in the joint venture: __________.] Each HUBZone small business concern participating in the joint venture shall submit a separate signed copy of the HUBZone representation. (c) Definitions. As used in this provision- "Service-disabled veteran-owned small business concern"- (1) Means a small business concern- (i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and (ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran. (2) "Service-disabled veteran" means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16). "Small business concern" means a concern, including its affiliates that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and the size standard in paragraph (a) of this provision. "Veteran-owned small business concern" means a small business concern- (1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and (2) The management and daily business operations of which are controlled by one or more veterans. "Women-owned small business concern" means a small business concern- (1) That is at least 51 percent owned by one or more women; or, in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and (2) Whose management and daily business operations are controlled by one or more women. (d) Notice. (1) If this solicitation is for supplies and has been set aside, in whole or in part, for small business concerns, then the clause in this solicitation providing notice of the set-aside contains restrictions on the source of the end items to be furnished. (2) Under 15 U.S.C. 645(d), any person who misrepresents a firm's status as a small, HUBZone small, small disadvantaged, or women-owned small business concern in order to obtain a contract to be awarded under the preference programs established pursuant to section 8(a), 8(d), 9, or 15 of the Small Business Act or any other provision of Federal law that specifically references section 8(d) for a definition of program eligibility, shall- (i) Be punished by imposition of fine, imprisonment, or both; (ii) Be subject to administrative remedies, including suspension and debarment; and (iii) Be ineligible for participation in programs conducted under the authority of the Act.(End of provision) B.19 PERFORMANCE INFORMATION (The proposal must include two reference letters reflecting knowledge of the person directly involved under the contract including their work ethic, technical skills, and ability to provide positive customer service. The proposal must include a copy of two Quality Assurance reviews or peer reviews in the past two years.) = 20 POINTS; and (7) SUITABILITY (Identify those items that apply to you/your Company and include an explanation) (i) Professional liability claims and judgments made against the offeror; (ii) Previous denial or revocation of medical staff membership at another facility; (iii) Previous reduction, suspension, revocation, voluntary relinquishment, or non-renewal of privileges at another facility; (iv) Problems with alcohol or drug abuse; (v) Previous loss, suspension, restriction, denial, or voluntary relinquishment of professional licensure or professional society membership; (vi) Problems with health; (vii) Revocation or suspension as a Medicare or Medicaid provider; (viii) Professional liability cancellation within the past five (5) years; (ix) DEA licensing investigations or actions; (x) More than five (5) percent ownership of any medical facility, joint ownership or medical service, or equipment with a facility to which patients may be referred. = 20 POINTS. Technical and past performance, when combined, are approximately equal to cost or price. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. All responsible offerors may submit a proposal, which shall be considered by the Agency. Offers shall be submitted to the Billings Area Indian Health Service, 2900 Fourth Avenue North, Room 304, Billings, Montana 59101, no later than 4:00 p.m., on May 05,2013. The offer must be submitted in a sealed envelope, addressed to this office, showing the time specified for receipt, the solicitation number, and your company's name and address. Offers will also be accepted by e-mail at James.Hunter@ihs.gov or by fax at (406) 247-7108. ACCEPTANCE PERIOD: Your proposal must stipulate that it is predicated upon all the terms and conditions of this RFQ. In addition, it must contain a statement to the effect that it is firm for a period of at least 90 days from the date of receipt by the Government. PROPOSAL SUBMISSION INSTRUCTIONS: The Contractor shall provide evidence of, or submit a written response to, the technical evaluation factors in FAR 52.212-2. In addition, the Contractor shall submit a completed copy of FAR 52.212-3 with its offer.
