- Justification for Other Than Full and Open Competion The U.S. Department of Transportation (DOT) Federal Motor Carrier Safety Administration (FMCSA) intends to negotiate on a sole source basis with the Committee on National Statistics (CNSAT) of the National Academes of Sciences (NAS). This action is being processed in accordance with 41 U.S.C. 253(c) (3) as implemented by FAR 6.302-1(a)(2)(a) Only one responsible source and no other supplies or services. This requirement is for the analysis of Hours-of-Service (HOS) Research and Statistical Methods for Analyzing Large Data Sets. The contractor shall be required to convene an expert panel to analyze the state of knowledge related to hours-of-service and fatigue factors in motor carrier safety and driver health. The 10-member panel will hold five meetings over 18 months, after which it will issue a report with findings and recommendations based on the objectives outlined in the solicitation's Statement of Work. The Governmnet anticipates the award of a two year contract with a firm fixed pricing arrangement. This is not a request for competitive proposals. However, all information received will be considered by the Government. A determination by the Government not to compete this action based on this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Interested parties who believe they can meet the Agency's requirement are requested to submit in writing an affirmative response clearly demonstrating their technical capabilities. To be considered an affirmative response, all responses must include detailed technical information and other technical literature demonstrating the ability to meet the above requirements. In your response you must address each of the items listed above in sufficient detail to permit agency analysis to establish a bona fide capability to meet the requirement. Failure to submit documentation will result in the agency proceeding as stated above. Submit written responses by May 8, 2013, via email to: Rubie.King@dot.gov.
