- JUSTIFICATION AND APPROVAL FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity:Department of Veterans Affairs Office of Acquisition Operations Technology Acquisition Center 260 Industrial Way West Eatontown, NJ 07724 2. Description of Action: The proposed action is for a firm fixed-price delivery order issued under one of the National Aeronautics and Space Administration (NASA) Solutions for Enterprise Wide Procurement (SEWP) contracts for the renewal of maintenance and support services for brand name Centrify 2013 Direct Control Management Standard Version software that is registered to The Department of Veterans Affairs (VA) Enterprise Systems Engineering (ESE) Client Services. 3. Description of Supplies or Services: The proposed action is for the renewal of maintenance and support services for a quantity of 300 existing Centrify 2013 Direct Control Management Standard Version software licenses. Support services include 24/7 technical assistance and product updates. The government has already procured and implemented the software, which allows Apple desktops and laptops to be integrated into the Active Directory for monitoring and asset management. The maintenance of the Centrify 2013 Direct Control Standard Version software licenses ensures that the product remains operational, as well as provides updates and technical support. The total estimated price of the proposed action inclusive of the options is $ 4. Statutory Authority: The statutory authority permitting this exception to fair opportunity is 41 U.S.C. 4106(c) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505(b)(2)(i)(B) entitled, "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized." 5. Rationale Supporting Use of Authority Cited: Based on the market research described in paragraph 8 of this document, it was determined that limited competition is viable among authorized resellers for this brand name software. VA currently owns 3,000 Centrify licenses across the enterprise and is finishing up the last of the deployments. VA requires maintenance on this product to continue to update the functionality which provides maintenance and integration of Apple devices into VA's Active Directory system. Centrify owns all proprietary program language and intellectual property of all software products under the Centrify umbrella. There is no support or resale of this product outside of Centrify authorized resellers. Therefore, only Centrify authorized resellers can provide the support for this software. Although other products existing with capabilities none can satisfy VA requirements to integrate Apple desktops and laptops into the existing Centrify infrastructure. To introduce another software product would require a complete re-engineering of the existing infrastructure to manage Apple products operating across VA at a prohibitive cost that would never be recovered through competition. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. In accordance with FAR 5.202(a)(6), this effort is exempt from pre-award synopsis since the proposed contract action is an order placed under an existing Indefinite Delivery/Indefinite Quantity contract. 7. Actions to Increase Competition: In order to remove or overcome barriers to competition in future acquisitions for this requirement, the Government's technical experts will continue to perform market research to determine if there are any suites of products available that will enable future requirements to be competed. 8. Market Research: VA's technical experts conducted market research in January 2013 by researching similar product websites for the Centrify 2013 Direct Control Management Standard Version software requirements. ADmitMac and Quest Authentication software applications were the only other products with similar capabilities; however neither could satisfy VA requirements to integrate Apple desktops and laptops into the existing Centrify infrastructure. To introduce another software product would require a complete re-engineering of the existing infrastructure to manage Apple products operating across VA. Further market research was conducted via the NASA SEWP IV Product Verification and Manufacturer Lookup tool which resulted in 10 potential resellers of maintenance and support services for Centrify 2013 Direct Control Management Standard Version software. The resellers include two Original Equipment Manufacturers (OEM) Value Added Resellers (VARs) in Group A, one Service-Disabled Veteran-Owned Small Business (SDVOSB) VAR in Group B, five Small Business VARs in Group C, and two VARs in Group D. As a result, the research determined there is adequate competition among the resellers. Since there is adequate competition among small business resellers, quotes will only be solicited and accepted from Groups B and C. 9. Other Facts: None.
