Submittal Register SWPPP Checklist Statement of Work (SOW) Site Restoration Revegetation Spec Offeror Reps and Certs 1350 Overarching Dept of Labor Wage Decision Project Title: Demolish Indigenous Houses and Garages Buildings 6966, 6968, 9024 and 9026 at the U.S. Air Force Academy. Notice to Offeror(s)/Supplier(s): Funds are not presently available for this effort. No award will be made under this solicitation/RFP until funds are available. The government reserves the right to cancel this solicitation/RFP, either before or after the closing date for receipt of proposal. In the event the Government cancels this solicitation/RFP, the Government has no obligation to reimburse an offeror for any costs. (i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This combined synopsis/solicitation is issued as a request for proposal (RFP) # FA7000-13-T-0044. (ii) This combined synopsis-solicitation reference number is FA7000-13-T-0044 and is being issued as a request for proposal (RFP). (iii) This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-66, dated 01 April 2013. (iv) This acquisition is 100% set-aside for HUBZone certified Small Business under North American Industrial Classification System (NAICS) 238910 and Size Standard $14 million. (v) CLIN 0001 - Demolish Indigenous House and Garage Buildings 6966 and 6968 IAW the Statement of Work (SOW) - Unit: Lot (vi) CLIN 0002 - Demolish Indigenous House and Garage Buildings 9024 and 9026 IAW the Statement of Work (SOW) - Unit: Lot REQUIREMENT SPECIFICATIONS: Provide pricing for each of the following line items: LINE ITEM Description CLIN Qty Unit Price Extended Price Bldg. 6966, 6968 0001 1 $______ $ __________ Bldg. 9024, 9026 0002 1 $______ $ __________ TOTAL PRICE $___________ The following Federal Acquisition (FAR) clauses apply to this combined synopsis/solicitation and offerors MUST COMPLY with all instructions contained in FAR 52.212-1, Instructions to Offerors--Commercial Items, addenda applies: The contractor shall submit their quote on company letterhead to include the following: solicitation number, contact name, address, telephone number of the offeror, unit price, extended price, any discount terms, delivery terms, cage code, DUNS number, tax identification number, size of business, and acknowledgement of solicitation amendments if required. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer. Proposals must be received no later than 10:00 am Mountain Time, 24 May 2013 at 10 CONS/LGCA, 8110 Industrial Drive, Suite 200, USAF Academy, CO 80840-2315. Offers providing less than 130 calendar days for Government acceptance after the date offers are due will not be considered and will be rejected. A site visit will be conducted on 06 May 2013. All contractors shall meet at 10 a.m. local time in the dirt parking lot across from the Pass and ID building at the South Gate of the U.S. Air Force Academy, Colorado. Contractors who do not possess a current Contractor Access Badge to United States Air Force Academy (USAFA) must submit a list of those attending with the individual's name, date of birth, home address, driver's license number and issuing state so passes can be made available to access the USAFA. Anyone who plans to attend the site visit, but fails to contact the Contract Specialist prior to the deadline stated above will not be permitted to attend the site visit. The number of personnel for the site visit is limited to no more than four individuals per contractor. Questions will not be answered during the site visit. All questions are due in writing (email is acceptable) no later than 9 May 2013. The following factors shall be used to evaluate offers: 1.Technical Acceptability. 2. Price. The Government will evaluate the total price of the offer for the award purposes. (1) If the lowest priced evaluated offer is judged to have "Technical Acceptability" assessment, award shall be made to that offeror without further consideration of any other offers. If the lowest priced offeror is not judged to have "Technical Acceptability," the next lowest priced offeror will be evaluated and the process will continue (in order by price) until an offeror is judged to have "Technical Acceptability." An award, pending availability of funds, will be made to the lowest priced, technically acceptable, responsible offeror who responds to all items included in the solicitation (all or none) and complies with the terms of the Request for Proposal (RFP). (2) These are the technical areas that we will evaluate to determine the technical acceptability: a. Company's three year history of similar projects, including whether any Notices of Violation were received. Receipt of any Notice of Violations will not alone disqualify quotes. b. Reasonableness of proposed schedule. The Air Force estimates a period of performance of 154 days from Notice to Proceed. (3) The offers will be evaluated by key government personnel, rating the aforementioned technical areas on a pass or fail basis. Any offer receiving a "fail" rating on any of the technical areas will be ineligible and not considered for contract award. Technical and past performance, when combined, are EQUAL. However, quotes which are not rated as Technically Acceptable will be eliminated from the competition and receive no further consideration. (b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (End of provision) 52.212-5 CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS--COMMERCIAL ITEMS (NOV 2012) (DEVIATION) (a) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (a) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records-Negotiation. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract. (2) The Contractor shall make available at its offices at all reasonable times, the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved. (3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law. (b)(1) Notwithstanding the requirements of any other clause in this contract, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (b)(i) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause- (i) 52.203-13, Contractor Code of Business Ethics and Conduct (APR 2010) (Pub. L. 110-252, Title VI, Chapter 1 (41 U.S.C. 251 note). (ii) 52.219-8, Utilization of Small Business Concerns (DEC 2010) (15 U.S.C. 637(d)(2) and (3)), in all subcontracts that offer further subcontracting opportunities. (End of clause) 5352.201-9101 OMBUDSMAN (NOV 2012) (a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern. (b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions). (c) If resolution cannot be made by the contracting officer, the interested party may contact the Center/MAJCOM/DRU or AFISRA ombudsmen, Kelly S. (End of clause) 5352.223-9001 HEALTH AND SAFETY ON GOVERNMENT INSTALLATIONS (NOV 2012) (a) In performing work under this contract on a Government installation, the contractor shall: (1) Take all reasonable steps and precautions to prevent accidents and preserve the health and safety of contractor and Government personnel performing or in any way coming in contact with the performance of this contract; and (2) Take such additional immediate precautions as the contracting officer may reasonably require for health and safety purposes. (b) The contracting officer may, by written order, direct Air Force Occupational Safety and Health (AFOSH) Standards and/or health/safety standards as may be required in the performance of this contract and any adjustments resulting from such direction will be in accordance with the Changes clause of this contract. (c) Any violation of these health and safety rules and requirements, unless promptly corrected as directed by the contracting officer, shall be grounds for termination of this contract in accordance with the Default clause of this contract. (End of clause) 5352.242-9000 CONTRACTOR ACCESS TO AIR FORCE INSTALLATIONS (NOV 2012) (a) The contractor shall obtain base identification and vehicle passes, if required, for all contractor personnel who make frequent visits to or perform work on the Air Force installation(s) cited in the contract. Contractor personnel are required to wear or prominently display installation identification badges or contractor-furnished, contractor identification badges while visiting or performing work on the installation. (b) The contractor shall submit a written request on company letterhead to the contracting officer listing the following: contract number, location of work site, start and stop dates, and names of employees and subcontractor employees needing access to the base. The letter will also specify the individual(s) authorized to sign for a request for base identification credentials or vehicle passes. The contracting officer will endorse the request and forward it to the issuing base pass and registration office or Security Forces for processing. When reporting to the registration office, the authorized contractor individual(s) should provide a valid driver's license, current vehicle registration, valid vehicle insurance certificate, and refer to USAFA A-01 Contractor Access to USAFA Instruction to obtain a vehicle pass. (c) During performance of the contract, the contractor shall be responsible for obtaining required identification for newly assigned personnel and for prompt return of credentials and vehicle passes for any employee who no longer requires access to the work site. (d) When work under this contract requires unescorted entry to controlled or restricted areas, the contractor shall comply with [insert any additional requirements to comply with AFI 31-101, Integrated Defense, and AFI 31-501, Personnel Security Program Management] citing the appropriate paragraphs as applicable. (e) Upon completion or termination of the contract or expiration of the identification passes, the prime contractor shall ensure that all base identification passes issued to employees and subcontractor employees are returned to the issuing office. (f) Failure to comply with these requirements may result in withholding of final payment. (End of clause)
