Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION GENERAL SERVICES ADMINISTRATION DEPARTMENT OF HOMELAND SECURITY - CUSTOMS & BORDER PROTECTION FOR DIGITAL SIGNAGE TECHNICAL SUPPORT FOR PASO DEL NORTE-PEDESTRIAN REENGINEERING, EL PASO, TEXAS 1. Identification of the Agency and Contracting Activity: Agency: Customs & Border Protection (CBP). Contracting Activity: General Services Administration (GSA), Acquisition Management Division, Program Support Branch (7PQA). 2. Description of Action Being Approved: This is a justification for other than full and open competition for digital signage technical support for the PDN - Pedestrian Reengineering project, El Paso, Texas. 3. Description of Services Required: CBP has a need for an additional six months support for the configuration, manipulation, and operation of all Daktronics Venus LED signage software and system services in support of the pedestrian reengineering project at the PDN land port of entry (LPOE). 4. Identification of Statutory Authority: The statutory reference authorizing this action is Federal Acquisition Regulation (FAR) 6.302-5(b)(5), Sole source awards under the HUBZone Act of 1997-15U.S.C.657a. This acquisition is essential to the agency requirements because digital signage technical support is needed for an additional six months. 5. Demonstration that the Acquisition Requires the Use of the Authority Cited: During a pre-final construction inspection of the PDN - Pedestrian Reengineering project in August 2011, CBP requested, and it was determined by the GSA program manager that there is a need for one-year technical support for the new LED signage software program. GarCom Inc., a subcontractor for V&R Construction, installed the software program and provided custom programming to the software to control the monitors; the system cannot be accessed remotely. The software signage program was designed by Omnivex, specifically for CBP and GarCom Inc. is the only licensed authorized distributor for Omnivex in the local El Paso area, and the technical support needed is specifically for Omnivex designed digital signage. Furthermore, in order not to void the warranty of the software, a licensed Omnivex technical support representative is required. GarCom Inc. has already provided training to CBP officers on the software system and is a certified HUBZone and Small Disadvantaged Business. As such, Contract number: GS-07P-12-HH-C-0004 was awarded to GarCom Inc. on October 20, 2011, as a HUBZone sole source award to support CBP's requirements for one year. Upon expiration of the mentioned contract, CBP requested an extension for an additional six months of technical support services. Therefore, the contractor's unique qualifications and the nature of the acquisition stated above require the use of the authority cited. If sole sourcing is not used for the prompt procurement of the software technical support services provided by GarCom Inc., there is a greater risk that operational requirements would not be met. This will negatively impact CBP's mission. 6. Description of Efforts to Solicit as Many Offers as Practicable: There have been no efforts to solicit other offers for this project. 7. Demonstration that the Anticipated Cost will be Fair and Reasonable: It is determined by the contracting officer that the anticipated cost for six months of additional technical support services for the software program will be fair and reasonable. A price analysis of the proposed price will be conducted as compared to the independent government estimate prepared by the technical team, based on industry standard. 8. Description of the Market Survey Conducted: SBA - Dynamic Small Business Search in El Paso County, Texas, under NAICS Code 541519, Other Computer related Services. The search returned no results. 9. Other Facts Supporting Other Than Full and Open Competition: None. 10. List of Sources that Expressed an Interest in the Acquisition: None 11. Statement of Actions to Overcome Barriers of Competition: There are no actions to be taken by the GSA that will prevent a similar situation to the one described above for subsequent acquisitions. 12. The Contracting Officer certifies by signature below that the information contained in this justification is accurate and complete to the best of his knowledge and belief. Upon the basis of the foregoing findings, I hereby determine that there is a reasonable basis to conclude that the above cited services will satisfy the agency's minimum needs and the services are only available from this source.
