- Justification for Other Than Full and Open Competition This is a "Special Notice" to process a "Sole Source" modification of an existing contract to add the Oprah Winfrey Network (OWN) to the current Option Year (1) and all remaining Option Years (2 - 4) for exclusive rights television programming. Reference Federal Business Opportunity (FBO) solicitation/ posting number "HQ002811C0016", for commercial items (television programming) posted in accordance with Office of Federal Procurement Policy Memorandum dated 17 APR 2006, as supplemented with additional information included in this notice. This government requirement, if solicited, would be advertised as an "Unrestricted" procurement with provisions and clauses in effect through Federal Acquisition Circular 2005-66 dated 01 Apr 2013. Contractors must be registered with the System for Award Management (SAM) database (https://www.sam.gov) at time award is issued and throughout performance. The government intends to award a "Sole Source" modification to contract HQ0028-11-C-0016 to add OWN to the contract as follows: Option Year 1 Effective dates: 20 May 2013 - 19 Aug 2013 Option Year 2 Effective dates: 20 Aug 2013 - 19 Aug 2014 Option Year 3 Effective dates: 20 Aug 2014 - 19 Aug 2015 Option Year 4 Effective dates: 20 Aug 2015 - 19 Aug 2016 Discovery Communications, LLC shall provide broadcast rights to its television programming aired on OWN to AFN to reproduce and distribute, provide live feeds or recorded copies of authorized programs and provide access to affiliate information data networks and/or websites. AFN will distribute the programming by encrypted, digitally compressed satellite transmission system (currently Cisco's PowerVu Plus (MPEG-4)) and/or by mail to authorized AFN television outlets outside the contiguous United States for their non-commercial distribution/presentation via television broadcast frequencies, encrypted, digitally compressed satellite transmission, and/or limited closed-circuit distribution systems. This "Special Notice" is not a request for competitive offers/quotes/proposals. A determination by the Government to compete this special notice will be based upon responses to this notice at the sole discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. Responses must be submitted within the close of the publication of this notice TO BE RECEIVED NO LATER THAN 2:00 PM PACIFIC TIME May 15, 2013 IN ORDER TO BE CONSIDERED.
