- JUSTIFICATION AND APPROVAL FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity:Department of Veterans Affairs Office of Acquisition Operations Technology Acquisition Center 260 Industrial Way West Eatontown, NJ 07724 2. Description of Action: The proposed action is for a firm fixed-price delivery order issued under a National Aeronautics and Space Administration (NASA) Solutions for Enterprise Wide Procurement (SEWP) contract for a quantity of 24 each Red Hat brand name Linux enterprise software licenses in support of The Department of Veterans Affairs (VA) Major Initiative (MI) entitled, "Transforming Health Care Delivery Through Health Informatics," also known as the Health Informatics MI. 3. Description of Supplies or Services: The proposed action for the procurement of 24 each Red Hat brand name Linux enterprise software licenses for a period of one year. Linux is a computer operating system assembled under the model of free and open source software development and distribution. Linux system distributions may vary in system operation, configuration and software package selections. Linux runs on a wide variety of computer hardware, including mobile phones, tablet computers, network routers, televisions, video game consoles, desktop computers, mainframes and supercomputers. Red Hat is a brand of Linux enterprise platform software. The total estimated price of the proposed action is $ 4. Statutory Authority: The statutory authority permitting this exception to fair opportunity is 41 U.S.C. 4106(c) as implemented by Federal Acquisition Regulation (FAR) Subpart 16.505(b)(2)(i)(B) entitled, "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized." 5. Rationale Supporting Use of Authority Cited: The Health Informatics MI project team coordinated with VA enterprise level technical staff to assess applicability and performance of this product for project needs and also comply with VA enterprise level common enterprise operating system software. As a result, the VA National Satellite Pool, which holds a pool of Red Hat software licenses under an existing VA Enterprise License Agreement (ELA), provided the Health Informatics MI project team with Red Hat licenses for use at their initial pilot site and on their development test server. In both applications, the Health Informatics MI project team determined that the Red Hat Linux enterprise server licenses provided performance sufficient to meet project needs. Only the Red Hat brand of software can meet the performance requirements for operating systems which are independent of the hardware supplier. Red Hat provides modularity and flexibility for deployment and physical configuration of the architecture which enables the Health Informatics MI project to maintain compliance with VA enterprise level common operating system software and mitigates the risk of introducing network interoperability issues into the VA enterprise network. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. In accordance with FAR 5.202(a)(6), this effort is exempt from pre-award synopsis since the proposed contract action is an order placed under an existing Indefinite Delivery/Indefinite Quantity contract. 7. Actions to Increase Competition: In order to remove or overcome barriers to competition in future acquisitions for this requirement, the Government's technical experts will continue to perform market research to determine if there are any suites of products available that will enable future requirements to be competed. 8. Market Research: VA's technical experts conducted market research in December 2012 by researching similar products for the Red Hat Linux product requirements. The similar products researched by the Office of Information and Technology (OIT) Enterprise Architecture (EA) group were AIX, HP-UX, and Solaris; however, none of these products provided the architecture requirements of modularity and flexibility in one software platform that the Red Hat Linux product provided. Further market research was conducted via the NASA SEWP IV Product Verification and Manufacturer Lookup tool resulted in 34 potential resellers of Red Hat Linux enterprise software licenses including seven Valued Added Resellers (VARs) and Original Equipment Manufacturers (OEMs) in Group A, six Service-Disabled Veteran-Owned Small Business (SDVOSB) VARs in Group B, twelve Small Business VARs in Group C, and nine VARs in Group D. As a result, the market research determined there is adequate competition expected among NASA SEWP IV resellers in Groups B and C. Accordingly, quotes will only be solicited from Groups B and C. 9.
