Description

This is a request for information (RFI) for planning purposes only. Announcement Number: FBO 267-13 Introduction and Purpose: With this RFI, Lawrence Livermore National Security (LLNS), requests information from interested parties regarding a potential lease of certain real property known as the Livermore Valley Open Campus under the management of LLNS for the purpose of private commercial use. LLNS seeks to gather information to fully analyze the leasing and/or design-build opportunity and to better understand questions and concerns of potential participants/lessees. LLNS will use the information received in response to this RFI to either amend this RFI or develop a subsequent RFI which contains specific projects of interest. LLNS may contemplate hosting an "Industry Day" to allow interested parties to view the site and ask questions. Responses may comment on the timing and proposed content of an Industry Day. LLNS will use the information received in response to both RFIs in determining whether to issue a solicitation for a leasing and design/build opportunity. If the decision is made to issue the solicitation the responses will be used to develop the content for that solicitation. If LLNS proceeds with a solicitation, it will then evaluate responses received and may select an offeror with whom to negotiate and enter into a lease agreement and/or a design-build agreement. Background Information: LLNS manages and operates the Lawrence Livermore National Laboratory (LLNL) under a long-term contract with the Department of Energy/National Nuclear Security Administration (NNSA). The NNSA has authorized LLNS to engage potential offerors to develop the LVOC. LLNS has begun coordination with NNSA to secure an appropriate land use instrument enabling a successful offeror to obtain NNSA permission to construct facilities on LVOC. The lease is for private commercial uses and unless otherwise specified in the solicitation, the federal government will not enter into a lease-back arrangement or require LLNS to lease space within improvements/facilities constructed pursuant to any agreement(s) under a prospective solicitation. The term of a lease will depend on several factors, including the amount of the lessee's financial investment in the project and LLNS's need for flexibility to use the property for future mission-related purposes. Leases may range from five to fifty years. The lessee will be required to comply with all applicable federal, state and local laws, rules, regulations, and ordinances applicable to activities taking place on the federal property as if it were private land. The lessee will also be required to comply with additional LLNS rules governing activities the LVOC property. Description of Project or Need: LLNS is considering the merits of leasing up to 78 acres of non-excess land for private commercial use on the North Campus site of the Livermore Valley Open Campus (LVOC). This site is located in Livermore, California, and is part of a larger 790 acre tract which LLNS will continue to manage for existing missions. The LVOC site located in the southeast corner of LLNL and abuts Greenville Road. A map approximately depicting the LVOC is attached (Attachment A). LLNS has preliminarily determined that the Property could be developed for private commercial uses, provided they are compatible with both LLNS's mission and surrounding land uses and allowed by applicable land use and development laws. Potential identified uses include: a high performance computing center or computer data center facility; a general use office building; a building to house a technically oriented business incubator; a satellite presence for academic institutions interested in developing new institutes and educational centers, including but not limited to teaching and experimental areas; and a research collaboration center which may contain basic technical research and auditorium space. Other uses may be possible, and one of the purposes of this RFI is to identify other potential uses. Desired Response: LLNS expects all expressions of interest to be commercially financeable and economically viable taking into account all associated commercial risk. In the response provided, please include answers to the following questions, together with any available supporting materials. •1. 1. Would you be interested in leasing the whole (need number) acres or one or more smaller portions of the Property? If smaller, how many acres? •2. Please describe a possible development and use for the Property, including possible associated design, site plan, development and construction schedule, and marketability. •3. What length of lease term would be needed to make the project feasible? •4. Please identify the potential issues or questions involving environmental and land use permitting/approvals, access, transportation and utilities infrastructure, and any applicable State and local land use, development, and construction laws, regulations, policies, or ordinances. •5. 5. To the extent possible with the information provided please provide an estimate of the development cost for the project as contemplated (or as suggested by you for the site) and explain how such costs be financed or paid, including an explanation of approximate percentage of debt and equity financing to be used, if any, and any assumptions used in providing the estimated cost. •6. 6. What are the current conditions, circumstances and/or constraints that would impact your interest and ability in submitting a detailed proposal in response to a solicitation, should one be issued? •7. 7. Please comment on the desirability, timing, and proposed content of a proposed "Industry Day" which would allow interested party access to the site and provide a possible forum for questions? •8. 8. What additional information from LLNS would be helpful in submitting a detailed proposal in response to a solicitation? (Note that LLNS will not provide an estimated fair market value of the lease interest.) •9. 9. Please include the following information about your organization: •· Name and address •· Summary of your business/services •· Organization's website, if any •· Point of contact, telephone number and e-mail address Handling and Processing: All responses received become the property of LLNS and may be held for an extended period of time or destroyed. In no case will LLNS return any responses to the originator. Respondents must clearly and appropriately identify and mark all information desired or required to be handled as proprietary or as confidential business information. Information clearly, conspicuously, and appropriately marked as proprietary or confidential will be safeguarded in accordance with the applicable LLNS procedures. LLNS shall not be liable for sharing, divulging, disseminating, or otherwise publicizing proprietary or confidential information which is not clearly, conspicuously and appropriately marked as such. LLNS will safeguard such information in accordance with the applicable federal regulations. LLNS may submit information received in response to this RFI to government or non-government consultants employed by LLNS to review and analyze the responses, and submitting proprietary or confidential information to LLNS shall be deemed consent to release such information to such consultants. These consultants sign non-disclosure agreements with LLNS. This RFI is issued for planning and information gathering purposes and does not constitute a commitment, implied or otherwise, that a solicitation will be issued. No entitlement to payment by the government of direct or indirect costs or charges will arise as a result of the preparation or submission of information. The federal government shall not be liable for any direct or consequential damages for any improperly identified proprietary information.
