Redacted Brand Name J&A Statement of Work (BOM Included) Synopsitation PDF ASY-0529 SPEC SHEET UPS12-475FR SPEC SHEET UPS12-100FR SPEC SHEET SYNOPSITATION for Uninterruptable Power Supply (UPS) Battery Replacement DESCRIPTION: COMBINED SYNOPSIS/SOLICITATION This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in the Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The Government reserves the right to award without discussions. The solicitation document, FA8604-13-Q-7015, is a Request for Quotes (RFQ) and incorporates FAR provisions and clauses in effect through Federal Acquisition Circular (FAC) 2005-66. The associated NAICS code is 335999, small business size standard is: 500 Employees. This RFQ is not a small business set-aside. This requirement is for the following brand name or equivalent Uninterruptable Power Supply (UPS) Units: *See Attached Bill of Materials (BOM), Statement of Work (SOW) and Spec Sheets. A Proposal for the installation and configuration of the batteries/units, in accordance with the attached Statement of Work, shall be included in the solicitation response and will be relied upon in the determination of technical capability. A copy of an executed agreement with the Eaton Corporation, in accordance with Section 3 of the SOW, for the configuration of the UPS units shall be included in the responses to this solicitation. The provision at 52.211-6, Brand Name or Equal, applies to CLINs 0001 - 0008 of this acquisition 52.211-6, Brand Name or Equal (a) If an item in this solicitation is identified as "brand name or equal," the purchase description reflects the characteristics and level of quality that will satisfy the Government's needs. The salient physical, functional, or performance characteristics that "equal" products must meet are specified in the solicitation. (b) To be considered for award, offers of "equal" products, including "equal" products of the brand name manufacturer, must- (1) Meet the salient physical, functional, or performance characteristic specified in this solicitation; (2) Clearly identify the item by- (i) Brand name, if any; and (ii) Make or model number; (3) Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer; and (4) Clearly describe any modification the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modification. (c) The Contracting Officer will evaluate "equal" products on the basis of information furnished by the offeror or identified in the offer and reasonably available to the Contracting Officer. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer. (d) Unless the offeror clearly indicates in its offer that the product being offered is an "equal" product, the offeror shall provide the brand name product referenced in the solicitation. The provision at 52.212-1, Instructions to Offerors - Commercial Items, applies to this acquisition The provision at 52.212-2, Evaluation--Commercial Items, applies; the only evaluation factors being technical capability and price. 52.212-3, Offeror Representations and Certifications - Commercial Items. If offeror has completed the annual representations and certificates electronically via https://www.acquisition.gov, offeror shall complete and submit only paragraphs 52.212-3(b), Offeror Representations and Certifications--Commercial Items, (below) with the offer. (1) Annual Representations and Certifications. Any changes provided by the offeror in paragraph (b)(2) of this provision do not automatically change the representations and certifications posted on the Online Representations and Certifications Application (ORCA) website. (2) The offeror has completed the annual representations and certifications electronically via the ORCA website accessed through https://www.acquisition.gov. Anticipated Award Date is: 07 May 2013 Ms. Jill Willingham has been appointed as Ombudsman. The purpose of the Ombudsman is to communicate contractor concerns, issues, disagreements, and recommendations to the appropriate government personnel.
