Description
Attachment Provide the following service in accordance with the requirements of the contract: SCHEDULE OF SERVICES: a. Blood Courier Services: The contractor shall provide the supplies/services identified herein to the Louis Stokes Cleveland, Department of Veterans Affairs Medical Center, 10701 East Blvd., Cleveland, Ohio 44106-1702. Note: STATs are emergency calls by the Contractor Officer Representative (COR), terms and conditions are listed in the following section. All other pick-ups, not listed as STAT, are on a regular schedule as listed below. b. Performance Schedule: Base Year and four (4) one year options, based upon date of award THE SCHEDULE DISCRIPTION/SPECIFICATIONS AND WORK STATEMENT 5.1 GENERAL: The contractor shall provide all necessary labor, materials, supervision and transportation vehicles required to perform and or provide the services herein. 5.2.1 SCOPE OF WORK: The contractor shall pick up and deliver blood, blood components, or specimens within thirty (30) minutes after the initial notification of a STAT emergency from the Contracting Officer's Representative (COR) on a 24 hour basis, seven (7) days per week, and all other blood or component pick-up and deliveries shall be made within two (2) hours of the initial notification from the COR. Specimen pick-ups from the CBOC Clinics listed herein shall be made Monday through Friday between the hours of 4:00 p.m. and 6:0() p.m. and delivered the same day between 6:00 p.m.-8:00 p.m., excluding federal holidays. Federal holidays include New Years Day, Martin Luther King Day, President's Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day and Christmas Day The contractor shall also be available to pick-up specimens from the Wade Park Blood Bank to take to the Cleveland Red Cross Reference Lab 24/7. They shall also be available to pick-up specimens from the Wade Park Hematology to deliver to University Hospitals 24/7. The contractor shall also be available to take blood or components from the Cleveland Red Cross or the Wade Park Blood Bank to University Hospitals for irradiation, and then return immediately to the Wade Park Blood Bank 24/7. Occasionally, the contractor may be asked to pick-up and deliver emergency reagents from Cleveland area hospitals to the Wade Park Hematology Lab 24/7. 5.2.2It shall be mandatory that each driver sign the log sheet at each facility during pickup with his/her name, date and time of pick-up and number of igloos picked up. It shall be mandatory that each driver sign the log sheet located at Wade Park at drop off of the igloos. The information required will be date and time of drop-off, driver, signature and number of igloos from each facility. All incoming igloos will be placed in the area(s) designated by Louis Stokes Cleveland, Pathology & Laboratory Medicine personnel. All outgoing igloos in the designated outgoing area must be picked up and returned to each facility. All outgoing igloos that are picked up must be delivered to the appropriate location the following working day. 5.2.3All courier drivers will be instructed on blood borne pathogens and documentation provided to the contracting officer with price proposal. Pathology and Laboratory Medical Service shall be notified as new drivers are added. Drivers are strictly prohibited from opening and unpacking the igloos. BLOOD BORNE PATHOGENS: Contractor and the employees provided, pursuant to this contract, shall comply with the effective VAMC Policy (and Occupational Health requirements in accordance with OSHA Blood Borne Pathogens (BBP) Law and the OSHA Tuberculosis Compliance Directive, enforceable under OSHA's General Duty Clause) governing health care workers infected with a blood borne pathogen. If the Contractor obtains information that a health care worker providing care pursuant to this agreement may be infected with a blood borne pathogen, Contractor will advise the Contracting Officer immediately. 5.2.4 Any foreseeable delayed delivery or pick up causing a cancellation of test(s), the re-drawing of the patient's blood specimen(s), and any extra pick-up or deliveries required to deliver the delayed igloo(s) to the location specified, will lead to a deduction from the weekly invoices of $15.00 per item(s) to recover costs associated with this event. The delivery fee shall also be deducted. Up to ten (10) missed pick-ups or courier errors may lead to termination of this contract for default. 5.2.5Contractor Employees: The Government reserves the right to restrict contractor employees from performing services under this contract, who violates federal regulations or is identified as a potential threat to the security, safety, health or the operational mission of this facility and it's population. Contractor's employees shall not loiter in or around the facility during off duty hours. The removal of such a person shall not relieve the contractor from providing all the required services described herein. Contractor shall wear neat, clean clothing. Employees must be identified by having company logo and/or name attached to their clothing. 5.2.6 Contractor Equipment, Vehicles and Inspection: The VA reserves the right to inspect Contractor's equipment and vehicles and/or require documentation of compliance with contract specifications, and State laws. VA inspections of Contractor facilities shall in no way constitute a warranty by the VA that the Contractor's vehicles and equipment are properly maintained. The VA reserves the right to restrict the Contractor's use of equipment and vehicles which are in need of repair, unclean, unsafe, damaged on the interior or exterior body, and are not in compliance with state law. The restriction of such equipment and vehicles shall not relieve the Contractor from performing in accordance with the strict intent and meaning of the contract without additional cost to the VA. The VA reserves the right to have VA personnel, such as Contracting Officer, Contracting Officer's Representative, or their designee, observe and inspect Contractor operations at any time during the term of this contract. HIPAA COMPLIANCE. HIPAA compliance is required. Contractor must adhere to the provisions of Public Law 104-191, Health Insurance Portability and Accountability Act (HIPAA) of 1996 and the National Standards to Protect the Privacy and Security of Protected Health Information (PHI). As required by HIPAA, the Department of Health and Human Services (HHS) has promulgated rules governing the security and use and disclosure of protected health information by covered entities, including the Department of Veterans Affairs (VA). In accordance with HIPAA, the Contractor will be required to enter into a Business Associate Agreement (BAA) with VA. SERVICES a.The services specified herein may be changed by written modification only prepared by the Contracting Officer. b.There is no employer-employee relationship between the VA and the contractor of the contractor's employee (s). c.This is a non-personal services contract. 2. HHS/OIG To ensure that the individuals providing services under the contract have not engaged in fraud or abuse regarding Sections 1128 and 1128 a of the Social Security Act regarding federal health care programs, the contract is required to check the Health and Human Services - Office of Inspector General (HHSA/OIG), List of Excluded Individuals/Entities on the OIG website (www.hhs.gov/oig) for each person providing services under this contract. Further the Contractor is required to certify in its proposal that all person listed in the contractor's proposal have been compared against the OIG list and are NOT listed. During the performance of this contract the Contractor is prohibited from using any individual or business listed on the List of Excluded Individuals/Entities. 3. DESIGNATION OF CONTRACT REPRESENTATIVE: A VAMC representative of the Contracting Officer will be designated to represent the Contracting Officer in furnishing technical guidance and advice regarding the work being performed under this contract. The foregoing is not to be construed as authorization to interpret or furnish advice and information to the Contractor relative to the financial or legal aspects of the contract. Enforcement of these segments is vested in and is the responsibility of the Contracting Officer. 4. COMPUTER SECURITY (a) VA may provide Contractor and subcontractor, if any, with access to Department of Veterans Affairs (VA) automated patient records and general files maintained on VA computer systems. Contractor, Contractor's employees, and Contractor's subcontractors (if any) shall maintain, access, release, and otherwise manage the information contained in the automated patient record and general file system in accordance with all federal laws governing that information, including federal laws applicable to federal agency records. Contractor shall take reasonable safeguards, both physical and electronic, to safeguard the information and prevent unauthorized disclosures. Contractor, Contractor's employees, and Contractor's subcontractors (if any) shall follow all VA policies governing access to, release of, and management of the information maintained in the automated system. Contractor shall take steps to ensure that its employees and subcontractors (if any) are bound by this requirement and subject to adverse action, up to and including termination of the relationship with Contractor, for failure to follow these requirements and that its employees and subcontractors, if any, meet the same requirements as VA employees for access to information contained in the automated record system. Contractor will utilize computers that are consistent with VA requirements and upgrade its computers if instructed to do so by VA in order to ensure compatibility with the VA system. (b) In performing this agreement, Contractor shall be considered a part of VA for purposes of 5 U.S.C. §552a, 38 U.S.C. § §5701 and 7332. Contractor's employees and agents may have access to patient medical records and general files to the extent necessary to perform this contract. Notwithstanding any other provision of this agreement, Contractor and/or its employees may not disclose information contained in general files and patient records and or other individually identified patient information, including information and records generated by the Contractor in performance of this agreement, except pursuant to explicit instructions from the VA. For the purposes of this paragraph, instruction to disclose may be provided by these officials only: Contracting Officer, Contracting Officer Representative, the Release of Information supervisor, or VA attorneys. (c) Records created by Contractor in the course of performing this agreement are the property of the VA and shall not be accessed, released, transferred, or destroyed except in accordance with applicable federal law, regulations, and policy. Access to data will be limited to the minimum necessary for performance of the contract. Contractor will take steps to ensure that access is limited to those employees who need access to the data to perform the contract. Contractor will not copy information contained in the system, either by printing to paper or by copying to another digital format, without the express permission of one of the officials listed in paragraph (b), above, except as is necessary to make single copies in the ordinary course of work performance under this contract. Contractor will not commingle the data from the system with information from other sources. Contractor shall report any unauthorized disclosure of VA information to the officials listed in paragraph (b). (d) If this agreement is terminated for any reason, Contractor will provide the VA with all individually-identified VA patient treatment records or other information in its possession, as well as any copies made pursuant to paragraph (c), above within seven (7) days of the termination of the agreement. (e) Certain information available from the database and other records created by the Contractor under this Agreement are medical quality assurance records protected by 38 U.S.C. §5705; its implementing regulations at 38 U.S.C. § §17.500-511; VHA Directive 98-016,4.b.(1)(d), 4.6(2)(c) and 4.6(4); and Minneapolis VA Medical Center Policy #PI-03, titled "Confidentiality of Continuous Improvement/Quality Management Documents. These records may be disclosed only as authorized by 38 U.S.C. §5705 and the VA regulations. Disclosure of these records in violation of §5705 is a criminal offense under 38 U.S.C. §5705(e). (f) Contractor shall follow all VA policies regarding the retention of records. In the alternative, Contractor may deliver the records to VA for retention. (g) Any changes in the law or regulations governing the information covered by this agreement during the term of this agreement shall be deemed to be incorporated into this agreement. Contractor shall educate its employees and subcontractors, if any, of the requirements of this section and shall advise its employees and subcontractors, if any, of any changes as they occur. On Contractor's request, VA will provide trainers who can educate Contractor's employees and subcontractors, if any, of their obligations under this section. (h) Contractor shall make its internal policies and practices regarding the safeguarding of medical and/or electronic information available to federal agencies with enforcement authority over the maintenance of those records upon request. 5. CONTRACTOR PERSONNEL SECURITY REQUIREMENTS All contractor employees who require access to the Department of Veterans Affairs' computer systems shall be the subject of a background investigation and must receive a favorable adjudication from the VA Office of Security and Law Enforcement. This requirement is applicable to all subcontractor personnel requiring the same access. All paper work required in paragraph (c) must be accepted as complete by Office of Security and Law Enforcement prior to contract performance. If the investigation is not completed prior to the start of the contract, the contractor will be responsible for the actions of those individuals they provide to perform work for VA. The following security determination for this position is: 1.Position Risk - In accordance with IL0710 and VA form 2280a the position risk has been designated as Low Risk/Nonsensitive. 2.Background Investigation - The level of background investigation to be initiated is NACI. 3.Contractor Responsibilities a.The contractor shall bear the expense of obtaining background investigations. If the investigation is conducted by the Office of Personnel Management (OPM), the contractor shall reimburse VA within 30 days. b.The contractor shall prescreen all personnel requiring access to the computer systems: (i) All personnel must be a U.S. Citizen or a legal U.S. resident with a proper work Visa. (ii) Applicants should be able to read, write, and understand the English language. c.The contractor shall submit or have their employees submit the following required forms to the VA Office of Security and Law Enforcement within 30 days of receipt: (i)Standard Form 85P, Questionnaire for Public Trust Positions (ii)Standard Form 85P-S, Supplemental Questionnaire for Selected Positions (iii)FD 258, U.S. Department of Justice Fingerprint Applicant Chart (iv)VA Form 0710, Authority for Release of Information Form (v)Optional Form 306, Declaration for Federal Employment (vi)Optional Form 612, Optional Application for Federal Employment d.The contractor, when notified of an unfavorable determination by the Government, shall withdraw the employee from consideration from working under the contract. e.Failure to comply with the contractor personnel security requirements may result in termination of the contract for default. 6. AWARDED CONTRACTOR TO PROVIDE After contract award and prior to contract performance, the contractor will provide to the Contracting Officer the following information immediately post award: 1.List of names of contractor personnel. 2.Social Security Number of contractor personnel. 4.Birth date of the contractor personnel. 5.City and state of the contractor birth place. 6.E-mail and home address of contractor personnel and/or the contractor's point of contract information. The contracting officer will provide this information to the Office of Security and Law Enforcement. The Office of Security and Law Enforcement will provide the necessary investigative forms to the contractor's personnel coordinate the background investigations and notify the contracting officer and contractor of the results of the investigations. 7. PRIVAICY AND SECURITY TRAINING FOR COMPUTER ACCESS All Contractor employees and subcontractors under this contract are required to complete the VA's on-line Security Awareness Training Course and Privacy Awareness Training course annually. Contractors must provide signed certifications of completion to the Contracting Officer and/or Information Security Officer during each year of the contract. 9. VA INTERNET AND INTRANET STANDARDS The contractor shall adhere to and comply with VA Directive 6102 and VA Handbook 6102, Internet/Intranet Services, including applicable amendments and changes, if the contractor's work includes managing, maintaining, establishing and presenting information on VA's Internet/Intranet Service Sites. This pertains, but is not limited to: creating announcements; collecting information; databases to be accessed, graphics and links to external sites.
