This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. (II) This solicitation is issued as a Request for Quote (RFQ) and has been assigned Solicitation Number: RA133W-13-RQ-0348. The Government intends to award a firm-fixed-price contract resulting from this solicitation of the offer that represents the lowest price technically acceptable proposal. (III) This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-66, effective April 1, 2013. (IV) This solicitation is being issued as a Service-Disabled Veteran-Owned Small Business Set-Aside. The associated NAICS code is 541990 - - All Other Professional, Scientific, and Technical Services. The small business size standard is $14 Million. (V) This solicitation is for a contractor to provide services to take, disseminate and record Radiosonde Observations. (VII) Date(s) and Place(s) of Delivery and Shipping Terms: All deliveries shall be shipped FOB Destination to addresses identified in the PWS. (VIII) FAR 52.212-1, Instructions to Offerors - Commercial Items (FEB 2012) applies to this acquisition. To be eligible for award, offerors must be registered in the System for Award Management (SAM) database at www.sam.gov; offerors must also obtain a Data Universal Numbering System (DUNS) number and provide it with the offer. Standard Form 1449 is included with this solicitation. Include a signed and dated SF 1449 with your proposed pricing on page 3. Electronic submission of the contractor's proposal is hereby authorized, but must be transmitted by the posted response date and time. Additional Instructions to Offerors: (a) Offerors shall submit information which clearly and concisely relates to the evaluation criteria in Part IX, specifically addressing the following: TECHNICAL CAPABILITY: Offerors shall provide sufficient detailed information which demonstrates their technical capability, proposed technical approach, how they plan to meet the specified requirements, and supplement the narrative with proof of required certifications/licenses from the National Weather Service, and resumes of proposed Key Personnel with relevant upper air observations experience. Also provide a plan for substitution or replacement of certified observers if needed. PAST PERFORMANCE: Offerors shall demonstrate relevant past performance or affirmatively state that it possesses no relevant past performance. Relevant past performance is performance under contracts or efforts (within the past 3 years) that is of the same or similar scope, magnitude, and complexity to that which is described in this solicitation. Include a list of current/previous contracts that are of a similar nature to this solicitation that includes: contract numbers, points of contact with telephone numbers and other relevant information. Offerors that are newly formed entities or otherwise lack relevant prior contracts should list contracts and subcontracts. Resumes are required for all key personnel and applicable resources to be used in the effort being offered (where is or may not be easily apparent, also explain the relevancy of the past performance). Offerors are encouraged to describe any problems encountered and corrective actions taken on the identified contracts. NOAA reserves the right to obtain information for use in evaluating past performance from any all sources, including sources outside the Government. (b) Price quotes must generally adhere to the pricing structure established in the Schedule of Items. Each offeror's price proposal must be based on the offeror's own technical proposal, the Government's statement/scope of work, and other contractual requirements. If the prices to be used are based on a published price list, or catalog, the offeror shall so state, and provide a copy of the document with their price proposal. If the prices are to be based on established market price, not otherwise published, or are prices applicable only to the proposed contract, the offeror shall so state. APPLICABILITY TO SERVICE CONTRACT ACT The contractor shall adhere to the requirements of the Service Contract Act (SCA) and applicable Department of Labor (DOL) Wage Rate Determination. FOR INFORMATIONAL PURPOSES, a Collective Bargaining Agreement representing current employees providing upper air observations at Del Rio International Airport is in place through Condor Reliability Services, Inc. The contractor shall adhere to all applicable requirements of the Service Contract Act and the applicable Wage Rate Determination (ATTACHMENT IV) when calculating and paying salaries and benefits to labor categories proposed under the resulting contract. Overtime shall be paid in accordance with the Fair Labor Standards Act and other applicable labor laws. (IX) FAR 52.212-2, Evaluation - Commercial Items (Jan 1999), applies to this acquisition. The Government will award one contract resulting from this solicitation to the responsible offeror on the basis of the lowest evaluated price of quotes meeting or exceeding the acceptable standards for non-price factors, stated in the Performance Work Statement, Attachment I of this solicitation. The following factors shall be used to evaluate offers: Technical Capability, Past Performance and Price. TECHNICAL CAPABILITY EVALUATION: Offerors will be evaluated on their proposed technical approach and how they plan to meet the specified requirements, along with proof of required certifications/licenses, and resumes of proposed Key Personnel. PAST PERFORMANCE EVALUATION: The Government will conduct a performance assessment based on the quality of the past performance of the Contractor on similar contracts as it relates to the probability of successful accomplishment of the required effort. Information utilized may be obtained from the references listed in the proposal, other customers known to the Government, and/or others who may have useful and relevant information. The Offeror's past performance on related contracts will be evaluated to determine, as appropriate, successful performance of contract requirements, quality and timeliness of delivery of goods and services, effective management of subcontractors, cost management, level of communication between the contracting parties, proactive management and customer satisfaction. The Government reserves the right to assess the past performance of proposed subcontractors, if applicable. The Government will use its discretion to determine the sources of past performance information used in the evaluation, and the information may be obtained from references provided by the Offeror, the agency's knowledge of contractor performance, other Government agencies or commercial entities, or past performance databases. For example, the SSEB may review the National Upper-Air Station Performance Scores that are used by the National Weather Service to evaluate upper air station performance nationwide with respect to data availability, quantity and quality. Offeror's scores will be reviewed carefully. Conditions outside the contractor's control, such as equipment and communication failures requiring maintenance performance by the managing NWS Weather Forecast Office electronic and engineering staff will be taken into consideration when evaluating station scores. If an Offeror does not have a history of relevant contract experience, or if past performance information is not available, the Offeror will receive a neutral past performance rating; it will not harm or help a contractor's chance of award. (b) "Options." The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (End of Provision) 2. BASIS FOR PRICE EVALAUTION Pricing will be reviewed for fair and reasonableness. Evaluation of offer(s) will be in accordance with FAR Part 12.602, FAR Part 13.106, and as prescribed in FAR 52.212-2 Evaluation - Commercial Items. 3. FAR 52.217-5 EVALUATION OF OPTIONS (JULY 1990) Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s). (X) The offeror must submit a completed copy ATTACHMENT III, the provision at FAR 52.212-3, Offeror Representations and Certifications - Commercial Items (DEC 2012), with its proposal. Please note that the System for Award Management (SAM) is now the Official U.S. Government system that consolidated the capabilities of CCR/FedReg, ORCA, and EPLS. The offeror shall complete the annual representations and certifications electronically at the SAM website (www.sam.gov). (XI) The clause at FAR 52.212-4, Contract Terms and Conditions - Commercial Items (FEB 2012), applies to this acquisition. (XII) The clause at FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items (JAN 2013) applies to this acquisition. For a list of the specific subparagraphs in FAR 52.212-5 that apply to this acquisition, refer to Attachment V, Applicable Clauses and Provisions. (XIII) For a list of additional FAR and Department of Commerce clauses and provisions that apply to this acquisition, refer to Attachment V, other Applicable Provisions & Clauses. (XIV) This acquisition is not rated by the Defense Priorities and Allocations System (DPAS). (XV) Quotes are required to be received in the contracting office no later than 2:00 P.M. MDT on May 13, 2013.
