- This is a Pre-Solicitation/Notice of Intent Synopsis for a sole source noncompetitive award to Life Technologies, Corporation, Carlsbad, CA for Preventative Maintenance Services for two Applied BioSystems Genetic Analyzers and one Applied BioSystems Sequence Detection System. The National Institutes of Health (NIH), National Heart, Lung, and Blood Institute (NHLBI), Office of Acquisitions (OA), on behalf of the DIR / Hematology Branch intends to negotiate and award a purchase order on a sole source noncompetitive basis for preventative maintenance services for two Applied BioSystems Genetic Analyzers (S/N #1604-018 and S/N #1352-014) and one Applied BioSystems Sequence Detection System (S/N #200564) to Life Technologies, Carlsbad, CA. (Note: during the last quarter of 2012, Applied Biosystems legally became Life Technologies). Investigators in the Hematology Branch study the clinical features and laboratory pathophysiology of a wide variety of bone marrow failure states, hematological malignancies, and single or multi-lineage cytopenias. There are many active IRB-approved Hematology Branch research protocols for these types of subjects where requests are made for CLIA regulated diagnostic genetic analysis. An example of our protocols/projects requiring genetic analysis is for patients who participate in Clinical Protocol # 97-H-0041 or Project #94-H-0010. In these studies, some patients with aplastic anemia (AA) or severe aplastic anemia (SAA) are screened for Telomerase RNA component (TERC) gene mutations and these gene mutations are revealed by genetic analysis using the ABI 3130xL and the TF, Big Dye Terminator (BDT) v3.1 reagent & SEQ BUFFER (the companion sequencing buffer). TERC is an RNA gene found in eukaryotes, which is a component of telomerase used to extend telomeres. This procedure using the genetic analyzers and the associated reagents and instruments/accessories manufactured by Life Technologies (formerly Applied Biosystems). The Centers for Medicare & Medicaid Services (CMS) regulate all laboratory testing (except research) performed on humans in the U.S. through the Clinical Laboratory Improvement Amendments (CLIA). The Division of Laboratory Services, within the Survey and Certification Group, under the Office of Clinical Standards and Quality (OCSQ) has the responsibility for implementing the CLIA Program. Diagnostic testing under CLIA regulation requires that the genetic analyzers be calibrated and maintained in accordance with manufacturer specifications. The period of performance will be one-year from date of award. The basis for the sole source determination is based upon the fact that: Life Technologies does not authorize any third party service provider to perform maintenance and repair on Applied Biosystems instruments. Life Technologies is the only manufacturer authorized service provider for AB instruments. Life Technologies maintains IP rights to its collection software and service tools software. Third party resellers and service providers are strictly prohibited from accessing, using or selling this software. Life Technologies has not entered into any agreement with any Asset Management or Insurance company. This acquisition is conducted under the authority of 41 U.S.C. 253(c) as set forth under FAR Part 13.106-1 (b) and is exempt from the requirements of FAR Part 6, Competition Requirements. The North American Classification System (NAICS) code applicable to this requirement is 334516 - Analytical Laboratory Instrument Manufacturing with a size standard of 500 employees. This Pre-Solicitation/Notice of Intent is not a request for competitive proposals. This announcement constitutes the only notice; proposals are not being request and a written solicitation will not be issued. The determination by the Government to award a contract on a sole source noncompetitive basis for the preventative maintenance services for two Applied BioSystems Genetic Analyzers and one Applied BioSystems Sequence Detection System to Life Technologies, Inc. Carlsbad, CA is solely within the discretion of the Government. Any information received as a result of this Pre-Solicitation/Notice of Intent will be considered solely for the purpose of determining whether to conduct any future competitive procurement. Interested parties may identify their interest and capability for any future competitive procurement by responding to this notice in writing, no later than May 10, 2013 at 11:59 p.m. EST. Responses to this notice shall contain sufficient documentation to establish the interested parties' bona-fide capabilities for fulfilling the requirement.
